<br />- <br />~ 34 <br />"..-! <br />i"'"\ <br /> <br /> <br /> <br /> <br />ORDINANCE 1991- 41 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL <br />ZONING MAP OF THE CITY BY ZONING LOT 1, BLOCK <br />3 OUT OF THE C.D. WALLACE SUBDIVISION IN THE <br />CITY OF SAN MARCOS, TEXAS, AS RECORDED IN <br />VOLUME 136, PAGE 112 OF THE HAYS COUNTY DEED <br />RECORDS, LOCATED AT 121 STAPLES ROAD FROM <br />"MF-4" MULTI-FAMILY DISTRICT (HIGH DENSITY) TO <br />"R-1" SINGLE-FAMILY DWELLING DISTRICT (LOW <br />DENSITY) AND DECLARING AN EFFECTIVE DATE. <br /> <br />WHEREAS, on June 4,1991, the Zoning Commission of the City of <br />San Marcos held a public hearing regarding a request to change the <br />zoning from "MF-4" Multi-Family District (High Density) to "R-1" <br />Single-Family Dwelling District (Low Density) for Lot 1, Block 3 <br />of the C.D. Wallace Subdivision as recorded in Volume 136, Page 112 <br />of the Hays County Deed Records. <br /> <br />WHEREAS, subsequent to the public hearing on that date, the <br />Zoning Commission did, on June 4, 1991 consider the request and <br />voted to approve it and has recommended that the request be <br />approved by the City Council of the City; and, <br /> <br />WHEREAS, the City Council held a public hearing on the 26th <br />day of August, 1991, regarding the request; and, <br /> <br />WHEREAS, all requirements of Appendix A, General Zoning <br />Ordinance, of the Code of Ordinances of the City of San Marcos <br />pertaining to amendments have been met; and, <br /> <br />WHEREAS, the city Council hereby finds and determines that the <br />adoption of the following ordinance is in the interest of the <br />public health, morals, welfare and safety; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That the Official Zoning Map of the City, as <br />described in section 3 of the General Zoning Ordinance is hereby <br />amended to rezone the following described real property located at <br />121 Staples Road in San Marcos, Hays County, Texas, which is <br />presently zoned "MF-4" Multi-family District (High Density) to <br />"R-1" Single-family Dwelling District (Low Density): <br /> <br />LOT 1, BLOCK 3, C. D. WALLACE SUBDIVISION RECORDED IN <br />VOLUME 136, PAGE 112 OF THE SAN MARCOS HAYS COUNTY DEED <br />RECORDS. <br /> <br />SECTION 2. That this Ordinance shall be in effect ten (10) <br />days from and after its passage and after it has been subject to <br />reconsideration by the Council at its next regular meeting <br />following its passage, and providing that the Council did not vote <br />to reconsider it. If reconsidered on September 9, 1991it shall be <br />in effect ten days from and after its passage on that date if <br />approved. It shall not go into effect if denied. If not <br />reconsidered and approved it shall be published in a newspaper of <br />general circulation in the area as required by the Charter of the <br />City of San Marcos, Texas. <br /> <br />PASSED, APPROVED AND ADOPTED this 26th day of August, 1991, <br />subject to reconsideration at the next regular City council meeting <br />scheduled for September 9, 1991 . <br /> <br />Reconsidered yes no x <br />
