<br /> 51 <br /> RESOLUTION 1991 - 103 R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE <br /> CITY OF SAN MARCOS, TEXAS EXPRESSING THE <br /> CITY'S DESIRE TO HAVE THE AUTHORITY TO <br /> REGULATE OPEN ALCOHOLIC BEVERAGE <br /> CONTAINERS WITHIN THE CITY: AND <br /> DECLARING AN EFFECTIVE DATE. <br /> WHEREAS, the 72nd Legislature of the State of Texas will <br /> consider numerous issues affecting local governments: and <br /> WHEREAS, many Texas cities experience negative impact in <br /> the areas of public safety and economic development due to <br /> the inability to control open alcoholic beverage containers <br /> in a public place as that authority is preempted by the Texas <br /> Alcoholic Beverage Code: and <br /> WHEREAS, the City of San Marcos desires to express its <br /> position to the Texas Legislature of its preference that <br /> authority to regulate open alcoholic beverage containers <br /> within certain designated areas of home-rule municipalities <br /> be placed under the control of the municipalities: now, <br /> therefore <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS: <br /> PART 1. That the City Council of the City of San Marcos <br /> supports passage of legislation by the Texas Legislature <br /> which would allow home rule municipalities to regulate <br /> possession of open alcoholic beverage containers within <br /> designated portions of a city. <br /> PART 2. That the City ~-1anager is directed to <br /> communicate the purpose of this resolution to member s of the <br /> Texas Legislature and the Governor. <br /> Part 3. That the City Council of the City of San Marcos <br /> requests the Governor to add this issue of home-rule <br /> authority to the agenda of the called session(s) of the 72nd <br /> Legislature. <br /> PART 4. That this Resolution shall be in full force and <br /> effect immediately from and after its passage. <br /> ADOPTED this the 26thday of August , 1991. <br /> I <br /> M.
