- Qooo 71 0- - - . -, ~ ORDINANCE 1991- 54 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, ANNEXING TO THE CITY A TRACT OF LAND CONTAINING 42.47 ACRES OF LAND, MORE OR LESS, LOCATED SOUTH AND ADJACENT TO THE AIRCRAFT APRON OF THE SAN MARCOS MUNICIPAL AIRPORT, CALDWELL COUNTY, TEXAS, THIS LAND BEING LOCATED WITHIN THE EXTRATERRITORIAL JURISDICTION OF THE CITY AND LYING ADJACENT TO PRESENT CITY BOUNDARIES: APPROVING A SERVICE PLAN FOR THIS TRACT: EXTENDING THE BOUNDARY LIMITS OF THE CITY SO AS TO INCLUDE THIS TRACT: GRANTING TO THE INHABITANTS OF THIS TRACT ALL THE RIGHTS AND PRIVILEGES OF OTHER CITIZENS OF THE CITY: BINDING THE INHABITANTS BY ALL OF THE ACTS AND ORDINANCES, RULES AND REGULATIONS OF THE CITY: AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of San ~,1arcos, Texas, provided an opportunity for all interested persons to be heard at two (2) public hearings, held once on JulX 8, 1991 ,and once on July 22, 1991 , to conslder the proposed annexation by the City of San Marcos, Texas of 42.47 acres, more or less, of land formerly being part of the Gary Job Corps site located south of and adjacent to the aircraft apron of the San Marcos Airport, Caldwell County, Texas, and being more particularly described by metes and bounds in attached Exhibit A: and, WHEREAS, an on-site public hearing has not been requested in writing by more than 2Ø adults residing in this area: and, WHEREAS, notices of these public hearings were published in the San Marcos Daily Record, a newspaper having general circulation in the City and in the territory proposed for annexation, on June 27, 1991 , and July 10, 199L these dates being not more that twenty (2Ø) days nor less than ten (lØ) days prior to the hearings for which notices were given: and, ~vHEREAS, prior to the publication of notices of these hearings, the City Council of the City of San Marcos, Texas directed preparation of a service plan that provides for the extension of municipal services to the area proposed for annexation: and, ~vHEREAS, the proposed service plan was made available for inspection and explained to the inhabitants of the area to be annexed at the public hearings: and, WHEREAS, this 42.47 acre tract is contiguous and adjacent to the current boundaries of the City of San Marcos, Texas: now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That the property more particularly described in Exhibit A which is attached hereto and incorporated herein for all purposes, being 42.47 acres of land which was formerly a part of the Gary Job Corps site located south of and adjacent to the aircraft apron of the San Marcos
