<br /> -15- <br /> (5) Permits are non-transferable except as <br /> provided for in subsection (b) below. <br /> (6) Permits shall be valid for a period not to <br /> exceed three (3) years from the date of <br /> issuance. They shall be reviewed annually but <br /> may be modified at any time as the Control <br /> Authority deems necessary. <br /> (7) Permits may be revoked if the requirements for <br /> self-monitoring, reporting, compliance and any <br /> other requirement set forth in the permit or <br /> in this Article are not being met. The <br /> industrial user must immediately cease <br /> discharge upon permit revocation. <br /> (8) If the Director denies the permit or <br /> disapproves it pending receipt of additional <br /> information, he or she shall notify the <br /> applicant in writing via certified mail. The <br /> notice letter to the applicant shall be <br /> accompanied by a detailed statement of the <br /> reasons for the action. The reasons shall be <br /> based upon provisions in this Article. <br /> (9) Prior to renewal of the industrial waste <br /> permit, the applicant shall provide the <br /> Director with evidence that all residues <br /> generated by pretreatment systems have been <br /> legally disposed of in accordance with all <br /> federal, state and local regulations. <br /> (b) Administrative fees for new permit issuance, permit <br /> renewa l, permit transfer to different ownership, and <br /> surcharges shall be set by separate ordinance of City <br /> Council. <br /> (c) Application for permit renewal with permit renewal <br /> fee, shall be sent to the Director by certified mail at <br /> least sixty (60) days prior to permit expiration date. If <br /> the Director has not received the permit renewal application <br /> and renewal fee sixty (60) days prior to permit expiration <br /> date, application for new permit issuance shall be required. <br /> (d) Prior to the change of ownership of an industry, the <br /> new owner may have an existing valid industrial waste permit <br /> for that industry transferred into its name by providing <br /> written notice to the Control Authority and submitting a <br /> transferal fee and permit application containing sufficient <br /> information regarding the discharge of pollutants including <br /> those referred to in section 307(a) of the federal Clean <br /> Water Act as amended, and listed in Appendix B to 40 CFR <br /> 403. <br /> Sec. 30-100. SamÞlinq and testinq. <br /> <br /> (a) All sampling and analysis shall be performed in <br /> accordance with procedures established by the E.P.A. <br /> Administrator pursuant to Section 304(h) of the federal <br /> Clean Water Act as amended and 40 CFR 136 as amended. <br /> (b) Analysis shall be performed on suitable samples <br /> taken at the inspection port provided or other control point <br /> authorized by the Control Authority. <br /> (c) To detect unauthorized or accidental discharges, <br /> grab samples or time composites may be used. <br /> (d) The city may select an independent firm or <br /> laboratory to determine flow, BOD, TSS and other wastewater <br />
