Chamber shall provide office facilities at the San Marcos <br /> Chamber of Commerce building and utilities to EDC sufficient to <br /> allow EDC to carry out the economic development services described <br /> herein, in accordance with the budget approved by the City. <br /> c. Chamber shall obtain the advice and counsel of the EDC as <br /> to the hiring and firing of management-level Chamber employees <br /> responsible for EDC activities. <br /> D. Chamber shall not discriminate against any person, firm or <br /> organization in connection with this Agreement on the basis of <br /> inability to pay, age, sex, disability, race, nationality, or <br /> religion. <br /> E. Chamber shall not assign any interest in this Agreement <br /> nor delegate the performance of any of its duties without the prior <br /> written consent of City and EDC. <br /> IV. <br /> OBLIGATIONS OF THE CITY <br /> A. The City shall pay to the EDC and the Chamber, jointly, <br /> the sum of $60,000.00 not later than December 31, 1991. <br /> B. Prior to any continuation or renewal of this Agreement, <br /> the City shall have the right to conduct a performance review of <br /> EDC and Chamber activity under this Agreement. The following <br /> standards shall be used in measuring such performance: <br /> 1. The Dollar amount of development investments <br /> attracted through EDC activity. <br /> 2. The number of new employees that are committed to <br /> be employed by development attracted through EDC <br /> activity. <br />
