<br /> occupancy; <br /> ( i) at the end of the six (6) month period the structure <br /> shall be removed from the site for seventy-five (75) <br /> consecutive days. <br /> ( j) shall have permanent restrooms for employees available <br /> within 300 feet of the door of the Portable Food <br /> Service Facility for which written permission from the <br /> owner for use has been submitted to the Chief Building <br /> Official along with a site plan of the Food Service <br /> Facility on the land before a Temporary Certificate of <br /> Occupancy may be issued; no portable restroom <br /> facilities are allowed; <br /> (k) shall be franchised by the city if located on public <br /> property; and <br /> ( I) shall pay an administrative fee of $50.00 per Temporary <br /> Certificate of Occupancy. <br /> Sec. 5-1/2-4. Exemption. <br /> Food booths in conjunction with outdoor events of specified <br /> durations such as carnivals, Chilympiad, Mardi Gras, farmer's <br /> markets, etc. are exempted from the provisions of this chapter. <br /> Sec. 5-1/2-5. Effective date for existing facilities. <br /> Any mobile or temporary food service facility engaging in <br /> legal operations on the effective date of this chapter may <br /> continue to the expiration date of the Temporary Certificate of <br /> Occupancy. <br /> SECTION 2. That if any word, phrase, clause, sentence, or <br /> paragraph of this ordinance is held to be unconstitutional or <br /> invalid by a court of competent jurisdiction, the remaining <br /> provisions of this ordinance shall remain in effect as if the <br /> unconstitutional or invalid portion had not been adopted. <br /> SECTION 3. That all ordinances and resolutions or parts of <br /> ordinances or resolutions in conflict herewith are hereby <br /> repealed. <br /> SECTION 4. That any person violating any provision of this <br /> ordinance shall be deemed guilty of a misdemeanor and upon <br /> conviction shall be subject to the penalty provided in Section 1- <br /> 5 of the San Marcos Code of Ordinances. <br /> SECTION 5.
