ORDINANCE 2013 -31 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS AMENDING THE TRAFFIC REGISTER MAINTAINED UNDER SECTION 82.067 OF THE SAN MARCOS CITY CODE BY REDUCING THE SPEED LIMIT IN BOTH DIRECTIONS AND FOR THE FULL LENGTH. OF THE FOLLOWING STREETS IN THE RIO VISTA SUBDIVISION FROM 30 MILES PER HOUR TO 25 MILES PER HOUR: HAYNES STREET, FIELD STREET, SYCAMORE STREET, ROBERT STREET, RIO VISTA STREET AND MCKINNON STREET; AND INCLUDING PROCEDURAL PROVISIONS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. Pursuant to Sections 82.003 and 82.066 of the San Marcos Code, on the basis of finding that the prima facie speed limit is unreasonable and unsafe, the traffic register maintained under Section 82.067 of the City Code is amended by adding the following speed limits: Haynes Street, both directions, 25 m.p.h.; Field Street, both directions, 25 m.p.h.; Sycamore Street, both directions, 25 m.p.h.; Robert Street, both directions, 25 m.p.h.; Rio Vista Street, both directions, 25 m.p.h.; and McKinnon Street, both directions, 25 m.p.h. SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will continue in force if they can be given effect without the invalid portion. SECTION 3. All ordinances and resolutions or parts of ordinances or resolutions in conflict with this ordinance are repealed. SECTION 4. This ordinance shall be effective upon its adoption on second reading. PASSED AND APPROVED on first reading June 1. 8, 2013. PASSED, APPROVED AND ADOPTED on second reading on July 2, 2013.
