act on behalf of the CITY only to the extent provided herein and in the construction contract documents unless otherwise modified by written instrument in accordance with Section 1.3.13. Any instructions issued directly by the CITY to Contractor shall be immediately communicated to the ARCHITECT if the ARCHITECT was unavailable at the time of issuance of instructions. 1.3.4 The ARCHITECT shall conduct a pre-construction conference wi th the Contractor and members of the CITY's staff, to establish construction schedules and to identify key representatives of the parties and lines of communication. 1.3.5 The ARCHITECT and/or its consultants shall make on-site observations of all phases of the Project often enough to ensure familiarity with the progress and quality of the work, to determine if the work is proceeding in acceptable conformance with the construction contract documents, and to review the work with the CITY's designated representatives. However, such observations shall occur at least once per week. On the basis of such on-site observations as an Architect, the ARCHITECT shall keep the CITY informed of the progress and quality of the work through weekly meetings with the CITY's representative. The ARCHITECT will, in addition, conduct a monthly on-site meeting with representatives of the CITY and the Contractor. The ARCHITECT will prepare a record of these monthly meetings and distribute copies to the CITY and the CONTRACTOR. In performing these services, the ARCHITECT will endeavor to protect the CITY against defects and deficiencies in the quality and quantity of the work of the Contractor if such are wi thin the ARCHITECT's knowledge or should reasonably be wi thin the knowledge of the ARCHITECT. The ARCHITECT shall also be reasonably available to perform site visitations at the specific request of the City by the next business day after a request is made. 1.3.6 The ARCHITECT shall not have control or charge of and shall not be responsible for construction means, methods, techniques, ,sequences or procedures, or for safety precautions and programs in connection with the work, for the acts or omissions of the Contractor, Sub-contractors or any other persons performing any of the work, or for the failure of any of them to carry out the work in accordance with the construction contract documents unless such acts or omissions are due -7-
