<br />act on behalf of the CITY only to the extent provided herein and in the <br />construction contract documents unless otherwise modified by written <br />instrument in accordance with Section 1.3.13. Any instructions issued <br />directly by the CITY to Contractor shall be immediately communicated to <br />the ARCHITECT if the ARCHITECT was unavailable at the time of issuance <br />of instructions. <br />1.3.4 The ARCHITECT shall conduct a pre-construction conference <br />wi th the Contractor and members of the CITY's staff, to establish <br />construction schedules and to identify key representatives of the <br />parties and lines of communication. <br />1.3.5 The ARCHITECT and/or its consultants shall make on-site <br />observations of all phases of the Project often enough to ensure <br />familiarity with the progress and quality of the work, to determine if <br />the work is proceeding in acceptable conformance with the construction <br />contract documents, and to review the work with the CITY's designated <br />representatives. However, such observations shall occur at least once <br />per week. On the basis of such on-site observations as an Architect, <br />the ARCHITECT shall keep the CITY informed of the progress and quality <br />of the work through weekly meetings with the CITY's representative. <br />The ARCHITECT will, in addition, conduct a monthly on-site meeting with <br />representatives of the CITY and the Contractor. The ARCHITECT will <br />prepare a record of these monthly meetings and distribute copies to the <br />CITY and the CONTRACTOR. In performing these services, the ARCHITECT <br />will endeavor to protect the CITY against defects and deficiencies in <br />the quality and quantity of the work of the Contractor if such are <br />wi thin the ARCHITECT's knowledge or should reasonably be wi thin the <br />knowledge of the ARCHITECT. <br />The ARCHITECT shall also be reasonably available to perform site <br />visitations at the specific request of the City by the next business <br />day after a request is made. <br />1.3.6 The ARCHITECT shall not have control or charge of and shall <br />not be responsible for construction means, methods, techniques, <br />,sequences or procedures, or for safety precautions and programs in <br />connection with the work, for the acts or omissions of the Contractor, <br />Sub-contractors or any other persons performing any of the work, or for <br />the failure of any of them to carry out the work in accordance with the <br />construction contract documents unless such acts or omissions are due <br /> <br />-7- <br />
