"', <br />~ ~p <br /> <br />r: ir:; <br />I: '" <br /> <br />AMENDMENT NO. 1 TO TAX ABATEMENT <br />AGREEMENT BETWEEN THE CITY OF SAN MARCOS AND SAN <br />MARCOS FACTORY STORES, LTD. <br /> <br />STATE OF TEXAS <br /> <br />KNOW ALL PERSONS BY THESE PRESENTS: <br /> <br />COUNTY OF HAYS <br /> <br />CITY OF SAN MARCOS <br /> <br />I. <br /> <br />RECITALS <br /> <br />A. The City of San Marcos, Texas (the "city") and San Marcos <br /> <br />Factory Stores, Ltd. ("Factory Stores") entered into a Tax <br /> <br />Abatement Agreement (the "Agreement") dated February 14, 1990 and <br />recorded in Vol. 827, Page 799 et seq. in the Real Property Records <br /> <br />of Hays County, Texas. <br /> <br />B. The City has requested an amendment to Section IV.A. of <br /> <br />the Agreement to clarify the procedures under which the Agreement <br /> <br />will be given effect by the City and the Hays County Appraisal <br /> <br />District. <br /> <br />C. The City has requested an amendment to Section II.D. of <br /> <br />the Agreement to broaden the purposes for which a contribution by <br /> <br />Factory stores towards a public transportation system may be used. <br /> <br />D. Factory stores understands and consents to the amendments <br /> <br />as above described and as hereinafter delineated in this Amendment <br /> <br />No.1. <br /> <br />II. <br /> <br />AMENDMENTS <br /> <br />A. Paragraph A of section IV of the Agreement is hereby <br /> <br />amended by adding the following: <br />
