<br /> 139 <br /> RESOLUTION 1991- 132 R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br /> OF SAN MARCOS, TEXAS, ESTABLISHING A POLICY ON <br /> THE USE OF CITY MEETING ROOMS AND FACILITIES <br /> FOR NON-CITY FUNCTIONS; AND DECLARING AN <br /> EFFECTIVE DATE. <br /> WHEREAS, a need exists to establish a formal policy on the use <br /> of City meeting rooms and facilities for non-city functions; and, <br /> WHEREAS, the City Council finds and determines that a <br /> compelling interest exists for this policy to contain a prohibition <br /> against commercial activities at City meeting rooms and facilities, <br /> to avoid the association of such activities with the City; <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> PART 1. That the following City meeting rooms and facilities <br /> shall be available for use for non-city functions in accordance <br /> with the policies referred to in this resolution: <br /> (a) Charles S. Cock Home <br /> (b) Recreation Center in City Park <br /> (c) San Marcos Softball Complex-Gary Park <br /> (d) Rio Vista Swimming Pool <br /> (e) Dunbar Recreation Center <br /> (f) Memorial Park <br /> (g) Rio vista Park Pavilions <br /> (h) Fish Hatchery Community Building <br /> (i) Calaboose <br /> (j) Public Library Meeting Room <br /> (k) Lucio Park Little League Fields <br /> (l) Gary Complex Soccer Fields <br /> PART 2. That use of the Public Library Meeting Room shall be <br /> coordinated through the Library Director in accordance with <br /> policies approved by the Library Board, and use of the other <br /> facilities listed above shall be coordinated through the Parks and <br /> Recreation Director in accordance with policies approved by the <br /> Parks and Recreation Board. Use of city facilities that are <br /> covered by lease, license or similar agreements shall be subject to <br /> those agreements. <br /> PART 3. That the use of City meeting rooms and facilities <br /> shall be subject to the paYment of deposit and use fees established <br /> by ordinance. <br /> PART 4. That City meeting rooms and facilities shall not be <br /> made available for commercial purposes. IICommercial purposes II <br /> means a use intended to produce, or which in fact produces, profit <br /> for any private for-profit company, association, or corporation. <br /> PART 5. That, other than as stated in Part 4 above, City <br /> meeting rooms and facilities shall be made available on a non- <br /> discriminatory basis. <br />
