<br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY
<br />OF SAN MARCOS, TEXAS, AMENDING THE FUTURE LAND
<br />USE MAP OF THE MASTER PLAN OF THE CITY, FROM
<br />HIGH DENSITY RESIDENTIAL TO OFFICE AND
<br />PROFESSIONAL FOR LOTS 5 AND 6 AND A PORTION OF
<br />LOTS 1 AND 2 OF THE COLLEGE HEIGHTS ADDITION
<br />TO THE CITY OF SAN MARCOS, HAYS COUNTY, TEXAS,
<br />LOCATED AT 1106 NORTH L.B.J. DRIVE AND
<br />DECLARING AN EFFECTIVE DATE.
<br /> WHEREAS, on August 20, 1991, the Joint Planning and Zoning
<br />Commissions of the City of San Marcos held a public hearing
<br />regarding a request to amend the Future Land Use Map of the Master
<br />Plan from High Density Residential to Office and Professional for
<br />Lots 5 and 6 and a portion of Lots 1 and 2 of the College Heights
<br />Addition to the city of San Marcos, Hays County, Texas, located at
<br />1106 North L.B.J. Drive; and,
<br /> WHEREAS, subsequent to the public hearing on that date, the
<br />Commissions did, on August 20,1991, consider the request and voted
<br />to approve it and have recommended that the request be approved by
<br />the City Council of the City; and,
<br /> WHEREAS, the City council held a public hearing on the 4th day
<br />of November , 1991, regarding the request; and,
<br /> WHEREAS, all requirements of the Master Plan pertaining to
<br />amendments have been met; and,
<br /> WHEREAS, the City Council hereby finds and determines that the
<br />adoption of the following resolution is in the interest of the
<br />public, health, morals, welfare and safety; now, therefore,
<br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS,
<br />TEXAS:
<br /> PART 1. That the following described tract of real property
<br />located at 1106 North L.B.J. Drive, San Marcos, Hays County, Texas,
<br />which is in an area shown on the Future Land Use Map of the Master
<br />Plan of the City of San Marcos as High Density Residential shall be
<br />shown on that map as Office and Professional:
<br />DESCRIPTION OF A SURVEY OF 0.500 ACRES, MORE OR LESS,
<br />BEING ALL OF LOTS 5 & 6 AND A PORTION OF LOTS 1 & 2 OF
<br />COLLEGE HEIGHTS ADDITION TO THE CITY OF SAN MARCOS AS
<br />RECORDED IN VOLUME 144, PAGE 182 OF THE HAYS COUNTY DEED
<br />RECORDS AND BEING THE SAME TRACT OF LAND DESCRIBED IN A
<br />DEED FROM BENNO H. SIMON, ET UX, TO EDWARD RAY GREEN, ET
<br />UX, DATED MARCH 1, 1973 AND RECORDED IN VOLUME 256, PAGE
<br />843 OF THE HAYS COUNTY DEED RECORDS AND BEING MORE
<br />PARTICULARLY DESCRIBED BY METES AND BOUNDS AS FOLLOWS:
<br />BEGINNING at an 1/2" iron rod found for the west corner
<br />of Lot 5, the Green tract, and this tract at the
<br />intersection of the southeast line of Lamar Avenue and
<br />northeast line of L.B. Johnson Drive;
<br />THENCE with the southeast line of Lamar Avenue, the
<br />northwest line of Lots 5 and 1 and the northwest line of
<br />the Green tract N44°26'00"E 164.19 feet to 3/8" copper
<br />pipe found in a concrete curb for the north corner of the
<br />Green tract and the west corner of the remaining portion
<br />of that tract described in a deed from Fritz Moeller to
<br />Benno H. Simon, ut ux, dated August 1, 1951 and recorded
<br />in Volume 150, Page 493 of the Hays County Deed Records,
<br />pass at 119.13 feet and 1" iron pipe found in a concrete
