<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
<br />OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL
<br />ZONING MAP OF THE CITY BY RE-ZONING PART OF
<br />LOTS 5 & 6, BLOCK 4, D.S. COMBS ADDITION TO
<br />THE CITY OF SAN MARCOS, TEXAS, AS RECORDED IN
<br />VOLUME 42, PAGE 332 OF THE HAYS COUNTY DEED
<br />RECORDS, LOCATED AT 618 CENTRE STREET FROM
<br />"M" SINGLE-FAMILY, DUPLEX AND NEIGHBORHOOD
<br />BUSINESS DISTRICT TO "R-2" SINGLE-FAMILY
<br />DWELLING DISTRICT (MEDIUM DENSITY) AND
<br />DECLARING AN EFFECTIVE DATE.
<br />
<br />WHEREAS, on June 4,1991, the Zoning Commission of the City of
<br />San Marcos held a public hearing regarding a request to change the
<br />zoning from "M" (Single-Family, Duplex and Neighborhood Business
<br />District) to "R-2" Single-Family Dwelling District (Medium Density)
<br />for part of Lots 5 & 6, Block 4, D.S. Combs Addition to the City of
<br />San Marcos, as recorded in Volume 42, Page 332 of the Hays County
<br />Deed Records.

<br />WHEREAS, subsequent to the public hearing on that date, the
<br />Zoning commission did, on June 4, 1991 consider the request and
<br />voted to approve it and has recommended that the request be
<br />approved by the City Council of the city; and,
<br />
<br />WHEREAS, the City Council held a public hearing on the 4th
<br />day of November, 1991, regarding the request; and,
<br />
<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, the City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the
<br />public health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF' SAN MARCOS,
<br />TEXAS:
<br />
<br />SECTION 1. That the Official Zoning Map of the City, as
<br />described in Section 3 of the General Zoning Ordinance is hereby
<br />amended to rezone the following described real property located at
<br />618 Centre Street in San Marcos, Hays County, Texas, which is
<br />presently zoned "M" Single-Family, Duplex and Neighborhood Business
<br />District, to "R-2" Single-Family Dwelling District (Medium
<br />Density) :

<br />All that certain real property situated in the City of
<br />San Marcos, Hays County, Texas, and being a part of Lots
<br />Five (5) and six (6), in Block No. Four (4), of the D.S.
<br />Combs Addition to the City of San Marcos, according to
<br />the plat thereof now of record in Volume 42, page 332,
<br />Hays County Deed Records, and being more particularly
<br />described by metes and bounds as follows, to-wit:
<br />
<br />BEGINNING at a stake in the Northwest line of Center
<br />Street in the City of San Marcos, said stake being 62.67
<br />feet N. 44°E. of the South corner of Lot No. Five (5) in
<br />Block No. Four (4) of said D.S. Combs Addition, said
<br />South corner being in the Northeast line of Jackman
<br />Street;
<br />
<br />THENCE, N 46°W. a distance of 126.67 feet to a stake for
<br />corner;
<br />
<br />THENCE, N. 44°E. a distance of 52 feet to a stake for
