13 ORDINANCE 1991- 65 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE CITY'S ELECTRIC UTILITY TARIFFS AND WATER AND WASTEWATER BILLING ORDINANCES TO EXTEND THE TIME PERIOD WITHIN WHICH UTILITY BILLS MAY BE PAID WITHOUT A PENALTY SERVICE CHARGE; PROVIDING FOR SEVERABILITY; REPEALING ALL CONFLICTING ORDINANCES; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That Section 9~-1 of Chapter 9~ of the San Marcos Code of Ordinances is hereby amended to read as follows: Sec. 9~-1. San Marcos Electric utility Tariffs. The City of San Marcos Electric Utility Tariffs are hereby adopted as set forth in Exhibit .. A II which is attached hereto and incorporated herein for all purposes, and these tariffs are hereby adopted and shall remain in full force and effect until amended by ordinance duly passed, approved and adopted by the city council. This exhibit shall remain on file in the office of the city secretary. SECTION 2. That Section 30-19(a) of the San Marcos Code of Ordinances is hereby amended to read as follows: (a) The due date for all bills for water and/or wastewater service shall be the fifteenth (15th) day following the date of issuance. The penalty date for all such bills shall be the twentieth (20th) day following the date of lssuance. SECTION 3. That Section 30-20(b) of the San Marcos Code of Ordinances is hereby amended to read as follows: (b) A penalty service charge of ten percent (10%) shall be assessed against the portion of all delinquent bills for active accounts that is not paid before the penalty date. An account is considered inactive if it is delinquent for more than thirty (30) days. SECTION 4. That if any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the remaining provisions of this ordinance shall remain in effect as if the unconstitutional or invalid portion had not been adopted. SECTION 5. That all ordinances and resolutions or parts of ordinances or resolutions in conflict herewith are hereby repealed. SECTION 6. That the importance of this Ordiance creates an emergency and an imperative public necessity so that the provisions of the Charter requiring that ordinances shall be presented at three separate meetings and that no ordinance shall become effective until the expiratioon of ten (10) days following the date of its final passage be suspended, and these provisions are hereby suspended, and this Ordinance shall take effect and be in full force and effect from and after its adoption and after its publication in a newspaper of general circulation in the area as required by the Charter of the City of San Marcos, Texas.
