<br /> 13 <br /> ORDINANCE 1991- 65 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br /> SAN MARCOS, TEXAS, AMENDING THE CITY'S ELECTRIC <br /> UTILITY TARIFFS AND WATER AND WASTEWATER BILLING <br /> ORDINANCES TO EXTEND THE TIME PERIOD WITHIN <br /> WHICH UTILITY BILLS MAY BE PAID WITHOUT A <br /> PENALTY SERVICE CHARGE; PROVIDING FOR <br /> SEVERABILITY; REPEALING ALL CONFLICTING <br /> ORDINANCES; PROVIDING FOR PUBLICATION; AND <br /> DECLARING AN EMERGENCY. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> SECTION 1. That Section 9~-1 of Chapter 9~ of the San Marcos <br />Code of Ordinances is hereby amended to read as follows: <br /> Sec. 9~-1. San Marcos Electric utility Tariffs. <br /> <br /> The City of San Marcos Electric Utility Tariffs are hereby <br /> adopted as set forth in Exhibit .. A II which is attached <br /> hereto and incorporated herein for all purposes, and these <br /> tariffs are hereby adopted and shall remain in full force <br /> and effect until amended by ordinance duly passed, approved <br /> and adopted by the city council. This exhibit shall remain <br /> on file in the office of the city secretary. <br /> SECTION 2. That Section 30-19(a) of the San Marcos Code of <br />Ordinances is hereby amended to read as follows: <br /> (a) The due date for all bills for water and/or wastewater <br /> service shall be the fifteenth (15th) day following the <br /> date of issuance. The penalty date for all such bills <br /> shall be the twentieth (20th) day following the date of <br /> lssuance. <br /> SECTION 3. That Section 30-20(b) of the San Marcos Code of <br />Ordinances is hereby amended to read as follows: <br /> (b) A penalty service charge of ten percent (10%) shall be <br /> assessed against the portion of all delinquent bills for <br /> active accounts that is not paid before the penalty date. <br /> An account is considered inactive if it is delinquent for <br /> more than thirty (30) days. <br /> SECTION 4. That if any word, phrase, clause, sentence, or <br />paragraph of this ordinance is held to be unconstitutional or <br />invalid by a court of competent jurisdiction, the remaining <br />provisions of this ordinance shall remain in effect as if the <br />unconstitutional or invalid portion had not been adopted. <br /> SECTION 5. That all ordinances and resolutions or parts of <br />ordinances or resolutions in conflict herewith are hereby repealed. <br /> SECTION 6. That the importance of this Ordiance creates an <br />emergency and an imperative public necessity so that the provisions <br />of the Charter requiring that ordinances shall be presented at <br />three separate meetings and that no ordinance shall become <br />effective until the expiratioon of ten (10) days following the date <br />of its final passage be suspended, and these provisions are hereby <br />suspended, and this Ordinance shall take effect and be in full <br />force and effect from and after its adoption and after its <br />publication in a newspaper of general circulation in the area as <br />required by the Charter of the City of San Marcos, Texas. <br />
