<br /> ~ 26 <br /> - <br /> - <br /> ORDINANCE 1991-69 <br /> .AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, N1ENDING SECTIONS 29-111 AND 29-15Ø <br /> OF THE SAN MARCOS CODE OF ORDINANCES BY ADDING A NO <br /> PARKING TOW-AWAY ZONE ON BOTH SIDES OF HUTCHISON <br /> STREET; PROVIDING FOR SEVERABILITY; REPEALING ALL <br /> CONFLICTING ORDINANCES; PROVIDING A PENALTY; <br /> PROVIDING FOR PUBLICATION AND DECLARING AN <br /> EFFECTIVE DATE. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS: <br /> SECTION 1. That Section 29-111 of the San Marcos Code <br /> of Ordinances is amended to add the follmving streets <br /> codified in alphabetical order, upon which parking shall be <br /> prohibited: <br /> Hutchison Street, north side, from its intersection with <br /> Guadalupe Street east to its intersection with L.B.J. <br /> Drive <br /> Hutchison Street, south side, from its intersection with <br /> Guadalupe Street to a point 265 feet east. <br /> SECTION 2. That Section 29-15Ø(c) of the San Marcos <br /> Code of Ordinances is amended to add the following streets, <br /> codified in alphabetical order, from which illegally parked <br /> vehicles may be towed at the direction of a police officer: <br /> Hutchison Street, north side, from its intersection with <br /> Guadalupe Street east to its intersection with L.B.J. <br /> Drive. <br /> Hutchison Street, south side, from its intersection with <br /> Guadalupe Street to a point 265 feet east. <br /> SECTION 3. That if any word, phrase, sentence, section, <br /> or portion of this ordinance is found by a court of competent <br /> jurisdiction to be unconstitutional or unenforceable for any <br /> reason, the remaining provisions of this ordinance shall <br /> remain in effect. <br /> SECTION 4. That all ordinances or parts of ordinances <br /> in conflict herewith are hereby repealed. <br /> SECTION 5. That any person violating any provision of <br /> this ordinance shall be deemed guilty of a misdemeanor and <br /> upon conviction shall be fined in accordance with Section 1-5 <br /> of the San Marcos Code of Ordinances. <br /> SECTION 6. That this Ordinance shall be in effect ten <br /> (lØ) days from and after its passage, and it shall be <br /> published in a newspaper of general circulation in the area <br /> as required by the Charter of the City of San Marcos, Texas. <br /> PASSED AND APPROVED on first reading October 14, 1991. <br /> PASSED AND APPROVED on second reading October 28, 1991. <br /> PASSED, APPROVED AND ADOPTED November 4, 1991. <br />
