<br /> 38 <br /> AMENDMENT NO. 5 TO <br /> TEXAS COMMUNITY DEVELOPMENT PROGRAM <br /> CONTRACT NO. 707202 <br /> TEXAS DEPARTMENT OF HOUSING AND COMMUNITY AFFAIRS <br /> AND THE <br /> CITY OF SAN MARCOS <br /> STATE OF TEXAS <br /> COUNTY OF TRAVIS <br /> Section 1. <br /> The Texas Department of Housing and Community Affairs, an <br /> agency of the State of Texas, hereinafter referred to as <br /> "Department", and the City of San Marcos, hereinafter <br /> referred to as "Contractor", do hereby contract and agree to <br /> amend their original contract as initially executed by the <br /> Acting Executive Director of the Department effective <br /> December 15, 1988, through April 15, 1992, for the <br /> performance of economic development activities. <br /> Section 2. <br /> The parties hereto agree to amend the contract identified in <br /> Section 1 so that Special Condition "N" shall read as <br /> follows: <br /> N. Contractor shall ensure that an annual audit is performed <br /> of Environmental Projection System, Inc. I s compliance with <br /> its obligations under its Texas Economic Development Program <br /> Contract with the Contractor dated April 20, 1989. <br /> Section 3. <br /> The parties hereto agree that this amendment shall become <br /> effective upon execution by both the Deparment and the <br /> Contractor. <br /> Section 4. <br /> The parties hereto agree that this amendment shall require no <br /> change to previously approved funding. <br /> Section 5. <br /> The parties hereto agree that all of the terms of the <br /> Page 1 of 2 <br />
