<br />Agreement <br /> <br />or not customarily furnished in accordance with the standard <br /> <br />of <br /> <br />care <br /> <br />exhibited <br /> <br />by <br /> <br />Engineers who possess special expertise in the <br /> <br />type of work involved in this project. <br /> <br />1.5 TIME <br /> <br />1.5.1 The Engineer shall submit to the Owner within 90 calendar <br />days of the execution of this contract, the preliminary report <br />described in Section 1.1 of this Agreement, excluding time required <br /> <br />for <br /> <br />City <br /> <br />reviews. <br /> <br />The final construction contract documents shall be <br /> <br />submitted <br /> <br />within 120 calendar days of Owner's written authorization to <br /> <br />proceed <br /> <br />with <br /> <br />the <br /> <br />design phase. <br /> <br />This excludes time required for City <br /> <br />reviews. <br /> <br />As <br /> <br />used <br /> <br />herein <br /> <br />the <br /> <br />term <br /> <br />"final" <br /> <br />construction contract <br /> <br />documents, <br /> <br />plans <br /> <br />and <br /> <br />specifications shall be interpreted to mean the <br /> <br />construction <br /> <br />contract <br /> <br />documents, plans and specifications as reviewed <br /> <br />and finally approved by the Owner. <br /> <br />ARTICLE 2 <br /> <br />THE OWNER'S RESPONSIBILITIES <br /> <br />2.1 The Owner shall provide full information regarding <br />requirements for the project including Owner's design objectives, <br />constraints and criteria, including space requirements and <br /> <br />relationships, <br /> <br />flexibility <br /> <br />and <br /> <br />expandability, <br /> <br />special equipment and <br /> <br />systems and site requirements. <br /> <br />2.2 <br /> <br />If <br /> <br />the <br /> <br />Owner <br /> <br />provides <br /> <br />a <br /> <br />budget for the project it shall <br /> <br />include <br /> <br />contingencies <br /> <br />for <br /> <br />bidding, <br /> <br />changes <br /> <br />in <br /> <br />the <br /> <br />Work <br /> <br />during <br /> <br />construction, <br /> <br />and <br /> <br />other <br /> <br />costs <br /> <br />which <br /> <br />are <br /> <br />the responsibility of the <br /> <br />Owner, <br /> <br />including <br /> <br />those <br /> <br />described <br /> <br />in this Article 2 and in Paragraph <br /> <br />3.1.2. <br /> <br />The Engineer shall accept the Owner's authorization to bid the <br /> <br />project <br /> <br />as <br /> <br />evidence <br /> <br />that <br /> <br />arrangements <br /> <br />exist for fulfillment of the <br /> <br />-11- <br />
