<br />G. <br /> <br />H. <br /> <br />().. 4) 1"1',. <br />02'...,[ <br /> <br />C) <br />U <br /> <br /><) <br /> <br />The Property is not owned or leased by any member of the San <br /> <br />Marcos City Councilor any member of the Planning Commission <br /> <br />of the City or any member of the Zoning Commission of the <br /> <br />City. <br /> <br />VF agrees that all proposed improvements to the Property, as <br /> <br />described <br /> <br />in <br /> <br />Section <br /> <br />below, <br /> <br />shall <br /> <br />II, <br /> <br />conform <br /> <br />to <br /> <br />all <br /> <br />applicable City ordinances and regulations, including but not <br /> <br />limited to the City s Master Plan, <br /> <br />Subdivision Ordinance, <br /> <br />Zoning <br /> <br />Ordinance, <br /> <br />and <br /> <br />construction <br /> <br />codes. <br /> <br />The <br /> <br />City <br /> <br />has <br /> <br />reviewed <br /> <br />all <br /> <br />plans <br /> <br />and <br /> <br />specifications <br /> <br />for <br /> <br />the <br /> <br />proposed <br /> <br />improvements <br /> <br />described in Section <br /> <br />and agrees <br /> <br />that, <br /> <br />if <br /> <br />II <br /> <br />constructed substantially in accordance with such plans and <br /> <br />specifications, <br /> <br />the <br /> <br />improvements <br /> <br />will <br /> <br />conform <br /> <br />to <br /> <br />all <br /> <br />applicable city ordinances and regulations, including but not <br /> <br />limited to the City I S Master Plan, <br /> <br />Subdivision Ordinance, <br /> <br />Zoning Ordinance and construction codes. <br /> <br />I. <br /> <br />The obligations of VF under this Agreement are conditional <br /> <br />upon the execution and delivery, on or before May 31, 1990, <br /> <br />by VF and each of Hays County and the San Marcos Consolidated <br /> <br />Independent School District of a tax abatement agreement on <br /> <br />terms substantially similar to the terms of this Agreement. <br /> <br />II. <br /> <br />PROPERTY IMPROVEMENTS, JOB CREATION AND SALES TAX GENERATION <br /> <br />A. <br /> <br />VF agrees to construct facilities containing approximately <br /> <br />60,000 <br /> <br />feet <br /> <br />of <br /> <br />retail <br /> <br />merchandising, <br /> <br />storage and <br /> <br />square <br /> <br />office space, <br /> <br />on a portion of the Property, together with <br /> <br />parking facilities and and related improvements. <br /> <br />These <br />
