<br />G. <br /> <br />H. <br /> <br />B~! 7 <br /> <br />enD <br /> <br />-2- <br /> <br />F. <br /> <br />This Agreement is entered into subject to the rights of the <br /> <br />holders of outstanding bonds of the City. <br />The Property is not owned or leased by any member of the San <br /> <br />Marcos City Councilor any member of the Planning Commission <br /> <br />of the City or any member of the Zoning Commission of the <br /> <br />City. <br /> <br />Factory Stores agrees that all proposed improvements to the <br /> <br />Property, as described in Section II, below, shall conform to <br /> <br />all applicable City ordinances and regulations, including but <br /> <br />not limited to the City's Master Plan, Subdivision Ordinance, <br /> <br />Zoning <br /> <br />Ordinance, <br /> <br />and <br /> <br />construction <br /> <br />codes. <br /> <br />The <br /> <br />City <br /> <br />has <br /> <br />reviewed <br /> <br />all <br /> <br />plans <br /> <br />and <br /> <br />specifications <br /> <br />for <br /> <br />the <br /> <br />proposed <br /> <br />improvements <br /> <br />described in Section <br /> <br />and agrees <br /> <br />II <br /> <br />that, <br /> <br />if <br /> <br />constructed substantially in accordance with such plans and <br /> <br />specifications, <br /> <br />the <br /> <br />improvements <br /> <br />will <br /> <br />conform <br /> <br />to <br /> <br />all <br /> <br />applicable city ordinances and regulations, including but not <br /> <br />limited to the City I S Master Plan, <br /> <br />Subdivision Ordinance, <br /> <br />Zoning Ordinance and construétion codes. <br /> <br />I. <br /> <br />The obligations of Factory Stores and the City under this <br /> <br />Agreement are conditional upon the execution and delivery, on <br /> <br />or before May 31, 1990, by Factory Stores and each of Hays <br /> <br />County and the San Marcos Consolidated Independent School <br /> <br />District of a tax abatement agreement on terms substantially <br /> <br />similar to the terms of this Agreement. <br /> <br />II. <br /> <br />PROPERTY IMPROVEMENTS, JOB CREATION AND SALES TAX GENERATION <br /> <br />A. <br /> <br />Factory Stores agrees to construct and complete facilities <br /> <br />containing approximately <br /> <br />180,000 square <br /> <br />feet <br /> <br />of retail <br />
