<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
<br />OF SAN MARCOS, TEXAS, APPROVING THE TERMS AND
<br />CONDITIONS OF THE SALE OF LOTS 316, 317, 318,
<br />319, 32Ø AND 321 IN BLOCK FIFTEEN (15) OF THE
<br />,^mSTOVERADDITION TO THE CITY OF SAN MARCOS,
<br />LOCATED ADJACENT TO THE 12ØØ BLOCK OF BISHOP
<br />STREET, SAN MARCOS, TEXAS TO SCHEIB
<br />OPPORTUNITY CENTER, INC.; AUTHORIZING THE CITY
<br />~1ANAGER TO EXECUTE A SPECIAL \vARRANTY DEED
<br />CONVEYING SAID PROPERTY AND DECLARING AN
<br />EMERGENCY.
<br />
<br />WHEREAS, the City of San Marcos, Texas,
<br />certain real property in said City, to-wit:

<br />All of Lots Three Hundred Sixteen (316), Three Hundred
<br />Seventeen (317), Three Hundred Eighteen (318), Three
<br />Hundred Nineteen (319), Three Hundred Twenty (32Ø), and
<br />Three Hundred Twenty-one (321) in Block Fifteen (15) of
<br />the Westover Addition to the City of San Marcos, Hays
<br />County, Texas, according to the map or plat thereof
<br />recorded in Volume 59, Page 184, Hays County Deed
<br />Records, such property being located adjacent to the
<br />12ØØ Block of Bishop Street, San Marcos, Texas; and,
<br />
<br />WHEREAS, the City has adhered to the requirements of Section
<br />272.ØØ1 of the Local Government Code as amended which governs the
<br />sale or exchange of land by a political subdivision; and,
<br />
<br />\'lHEREAS, Scheib Opportunity Center, Inc. a non-profit Texas
<br />corporation located in San Marcos, Hays County, Texas submitted
<br />the highest bid; and,
<br />
<br />WHEREAS, the City desires to convey this property to Scheib
<br />Opportunity Center, Inc.; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS,
<br />TEXAS:
<br />
<br />SECTION 1. That the terms and conditions of the sale by the
<br />Ci ty of San Marcos, Texas, pursuant to Section 272. ØØ1 of the
<br />Local Government Code, as amended, of all of Lots Three Hundred
<br />Sixteen (316), Three Hundred Seventeen (317), Three Hundred
<br />Eighteen (318), Three Hundred Nineteen (319), Three Hundred Twenty
<br />(32Ø), and Three Hundred Twenty-one (321) in Block Fifteen (15) of
<br />the Westover Addition to the City of San Marcos, Hays County,
<br />Texas, according to the map or plat thereof recorded in Volume 59,
<br />Page 184, of the Hays County Deed Records, are hereby approved.
<br />
<br />SECTION 2. That the City Manager of the City of San Marcos,
<br />Larry D. Gilley, be, and he is hereby, authorized to execute a
<br />special warranty deed from the City of San Marcos to Scheib
<br />Opportunity Center, Inc.
<br />
<br />SECTION 3. That the importance of £his Ordinance creates an
<br />emergency and an imperative public necessity so that the
<br />provisions of the Charter requiring that ordinances shall be
<br />presented at three separate meetings and that no ordinance shall
<br />become effective until the expiration of ten (lØ) days following
<br />the date of its final passage be suspended, and these provisions
<br />are hereby suspended, and this Ordinance shall take effect and be
<br />in full force and effect from and after its adoption and after its
<br />publication in a newspaper of general circulation within the City
<br />as provided by the City Charter of the City of San Marcos.
