<br />815 <br /> <br />]' no <br />; ~1 ,Ý <br /> <br />notify the Reasoners when it is first determined that such work is <br /> <br />necessary and shall coordinate such work with the Reasoners. <br /> <br />(15) The <br /> <br />City <br /> <br />agrees <br /> <br />that <br /> <br />at <br /> <br />all <br /> <br />times <br /> <br />during <br /> <br />the <br /> <br />construction, operation, maintenance or repair of the pipelines <br /> <br />within the 1.15 Acre Permanent Easement or the roadway within the <br /> <br />1.77 Acre Permanent Easement that it will not divert or cause the <br /> <br />diversion of surface water on to the Reasoner Tract or impede the <br /> <br />flow of surface water off of the Reasoner Tract. <br /> <br />In the event the <br /> <br />City fails to meet this obligation, it agrees to pay the costs to <br /> <br />remedy the surface water problem and to pay all other damages <br /> <br />attributable to this problem within 30 days after the Reasoners <br /> <br />submit a statement to the city itemizing such damages. <br /> <br />(16) The City agrees that if it must cut or relocate any fence <br /> <br />located on the Reasoner Tract in connection with the scheduled <br /> <br />construction, maintenance, or repair work that it shall notify the <br /> <br />Reasoners 14 days in advance of the date and location of the <br /> <br />planned fence cut unless a shorter period of time is agreed to in <br /> <br />writing. <br /> <br />If any <br /> <br />fence is cut or relocated, the City agrees that <br /> <br />it will maintain the fence in such a condition that there is no gap <br /> <br />or <br /> <br />opening <br /> <br />in <br /> <br />the <br /> <br />fence. <br /> <br />Finally, <br /> <br />upon <br /> <br />completion <br /> <br />of <br /> <br />the <br /> <br />construction of the pipelines or roadway within the Permanent <br /> <br />Easements, the City agrees to return the fence to the same location <br /> <br />and condition as existed before the location and condition of the <br /> <br />fence was first altered to the extent it does not unreasonably <br /> <br />-7- <br />
