<br />or which may hereafter be enacted or promulgated by any governmental <br />body or agency having jurisdiction. SMEU shall in no way be responsible <br />for the construction. operation. or performanée of Licensee's television <br />system or any part thereof. In the event that the use of any pole or <br />poles is forbidden by law or is objectionable to any public authority. <br />SMEU. or property owner, the penult covering the use of such pole or <br />poles shall be subject to immediate terminatton~ and the attachment <br />shall be removed at once from the affected pole or poles upon written <br />notice from S~ŒU. <br />10. SMEU may use. change. operate. and maintain its poles and <br />facilities in connection with its business as it sees fit and in such <br />manner as will best enable it to fulfill its own service requirements <br />and shall not be liable to Licensee for any damage to or interference <br />with the operation of the facilities and appurtenances of the Licensee <br />on SMEU-owned poles and facilities caused by such use. operation. and <br />maintenance by SMEU of its poles and facilities. <br />11. Licensee shall in~emnify and save SMEU harmless against <br />any loss or damage that may resu1 t to any equi pment or other property. <br />or to any person or persons (including payments made under any Workmen's <br />Compefisation law or under any plan for employees' disability and benefits) <br />which may arise out of or be caused by the erection. ma1nte.nance. use. <br />or removal of Licensee's attachments and faci lities or be caused by <br />any act of Licensee. its agents. employees. and representatives. <br />12. Licensee shall secure liability insurance. satisfactory <br />to and in the name of the SMEU, covering bodily injury or death in an <br />amount of not less than $300,000/$1,000,000 and property damage in an <br />amount of not less than $100.000 and shall obtain a policy. or policies. <br />for such insurance and for any renewals thereof so long as this agreement <br />shall remain in effect. Licensee will carry at all times during the <br />life of this agreement Workmen's Compensation insurance. if it is eligible <br />for such insurance. All insurance required shall remain in force for <br />the entire life of this Agreement. Each company which insures licensee <br />shaH be required to furnish to SMEU a certification of the required <br />coverage for each location and shall agree that it will not cancel or <br />change any such policy of insurance issued to Licensee except after <br />thirty (30) days written notice to S~ŒU. A renewal certificate shall <br />be furnished to SMEU each year prior to the billing date. If the <br />certificate is not received prior to the billing date. SMEU shall assume <br />that the contract is to be terminated and shall notify 1 icensee of the <br />removal requirement for its facilities as provided for in Section 7. <br />13. Licensee shall furnish and maintain bond or satisfactory <br />evidence of contractual insurance in an amount of $10.000.00 to guarantee <br />the payment of any sums which may become due to SMEU for rentals. <br />inspections. or for work performed for the benefit of Licensee under <br />this agreement, including the removal of attachments upon termination <br /> <br />-3- <br />
