<br /> <br />!'C") <br />~ <br /> <br /> <br />44 <br /> <br />~ <br />~ <br />..... <br /> <br />ORDINANCE NO. 1990 - <br /> <br />7 <br /> <br /> <br />~ <br />~ <br />0 <br />rt'\ <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, EXTENDING THE TIME <br />PERIOD FOR ACCEPTANCE BY MISSION CABLE <br />ASSOCIATES, L. P. OF THE TERMS OF THE CABLE <br />TELEVISION FRANCHISE TRANSFER ORDINANCE <br />ADOPTED JANUARY 8, 1990; AND DECLARING AN <br />EMERGENCY. <br /> <br />WHEREAS, The City Council approved the transfer of the cable <br />television franchise from Karnack Corp. (Karnack) to Mission Cable <br />Associates, L.P. (Mission) in an ordinance adopted January 8, 199Ø; <br />and, <br /> <br />\vHEREAS, that ordinance required ~1ission to file its written <br />acceptance of the terms and conditions of the current cable <br />television franchise not later than twenty (2Ø) days after the <br />publication of the ordinance; and, <br /> <br />WHEREAS, Karnack and Mission have requested an extension of the <br />time period for Mission to file its acceptance in order to facilitate <br />approval of the franchise transfer by the Federal Trade Commission; <br />and, <br /> <br />WHEREAS, such an extension of time does not renew, amend or <br />extend the terms and conditions of the current cable television <br />franchise; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION ONE. That Part 3 of the ordinance adopted January 8, <br />1990 approving the transfer of the cable television franchise from <br />Karnack To Mission is hereby amended to read as follows; <br /> <br />That the approval to transfer the existing cable television <br />franchise from Karnack Corporation to JVlission Cable <br />Associates, L.P., and the amendment to such franchise <br />described in Part 2 above, shall be null and void unless <br />Mission files its written acceptance of the terms and <br />conditions of the cable television franchise ordinance, <br />Ordinance No. 1988-48, and of this ordinance, within twenty <br />(2Ø) days after approval of the transfer is given by the <br />Federal Trade Commission, or by April 15, 199Ø, whichever <br />occurs first; provided that ~1ission shall not file such <br />acceptance until the sale of facilities and equipment by <br />Karnack to Mission is completed. <br /> <br />SECTION TWO. That the importance of the matters stated in this <br />Ordinance creates an emergency and an imperative public necessity so <br />that the provisions of the Charter requiring that ordinances shall be <br />presented at three separate meetings and that no ordinance shall <br />become effective until the expiration of ten (lØ) days following the <br />date of its final passage be suspended, and these provisions are <br />hereby suspended, and this Ordinance shall take effect and be in full <br />force and effect from and after its adoption and after its <br />publication in a newspaper of general circulation within the City as <br />provided by the City Charter of the City of San Marcos. <br /> <br />PASSED, <br />199Ø. <br /> <br />APPROVED AND <br /> <br /> <br />26 <br /> <br />day of <br /> <br />January <br /> <br />r WL.
