<br /><-",::> <br />~- <br />\:(- <br />..... <br /> <br /> <br />¡<) <br /> <br /> <br />54 <br /> <br />ORnINANCE 1990- 10 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING THE CITY HISTORICAL ZONING <br />ORDINANCE WITH REGARD TO SUPPORT STAFF, REFERENCE TO <br />FEDERAL HISTORIC PRESERVATION STANDARDS, AND MEMBERSHIP <br />QUALIFICATIONS FOR THE HISTORIC PRESERVATION <br />COMMISSION; PROVIDING FOR SEVERABILITY; REPEALING ALL <br />CONFLICTING ORDINANCES; PROVIDING FOR PUBLICATION; AND <br />PROVIDING AN EFFECTIVE DATE. <br /> <br />BE IT ORDAINED BY THE CITY <br />TEXAS: <br /> <br />COUNCIL OF <br /> <br />THE <br /> <br />CITY OF <br /> <br />SAN <br /> <br />MARCOS, <br /> <br />SECTION 1: That subsection d of Section 3 of the Historical <br />Zoning Ordinance of the City, codified in Appendix G of the City of San <br />Marcos Code of Ordinances, is hereby amended to read as follows: <br /> <br />d. <br /> <br />Three (3) members, one from each Historic District: Two (2) <br />members shall be property owners from the San Antonio Street <br />Historic District (one member) and Belvin Street Historic <br />District (one member), and the remaining member shall be a <br />property owner or business owner within the Downtown <br />Historic District. <br /> <br />SECTION 2: That Section 6 of the Historical Zoning <br />the City is hereby amended to read as follows: <br /> <br />Ordinance <br /> <br />of <br /> <br />Section 6. <br /> <br />Same---Meetinqs; support staff. <br /> <br />(a) The commission shall elect from its membership a chair who <br />shall serve for a term of one year and who shall be eligible <br />for reelection. The chair shall preside over the commission <br />and shall have the right to vote. The commission shall hold a <br />regular meeting on the first Thursday of each month. Deadlines <br />for filing applications for certificates of appropriateness <br />shall be determined by the commission. <br /> <br />(b) The Director of Planning or the Director's designee shall <br />provide professional staff support to the Historic Preservation <br />Commission and shall attend all meetings and workshops held by <br />the Commission. <br /> <br />SECTION 3. That Section 18 of the Historical Zoning Ordinance of <br />the City is hereby amended to add a new subsection (c) to read as <br />follows: <br /> <br />(c) The commission may use as general guidelines, in addition <br />to the specific guidelines contained in subsections (a) and (b) <br />above, the current Standards for Historic Preservation Projects <br />issued by the Secretary of the Interior of the United States. <br /> <br />SECTION 4. If any word, phrase, clause, sentence or section of <br />this ordinance is found to be unconstitutional or invalid by a court of <br />competent jurisdiction, this finding shall not affect the validity of <br />the remainder of this ordinance. <br /> <br />SECTION 5. The San Marcos Historical Zoning Ordinance repeals all <br />ordinances or parts of ordinances in conflict herewith. <br /> <br />SECTION 6. That this Ordinance shall be in effect ten (10) <br />days from and after its passage, and it shall be published in a <br />newspaper of general circulation in the area as required by the Charter <br />of the City of San Marcos, Texas. <br /> <br />PASSED AND APPROVED on first reading <br /> <br />January 8, 1990. <br /> <br />PASSED AND APPROVED on second reading <br /> <br />January 22, 1990. <br /> <br />PASSED, APPROVED AND ADOPTED <br /> <br />February 12, 1990. <br /> <br />Kathy M <br />Mayor <br /> <br /> <br />¡lA.þ <br />
