<br />188 <br /> <br />Exhibit B <br /> <br />STATE OF TEXAS <br /> <br />LEASE AMENDMENT NUMBER ONE <br /> <br />COUNTY OF CALDWELL <br /> <br />KNOW ALL PERSONS BY THESE PRESENTS THAT: <br /> <br />The <br /> <br />City <br /> <br />of <br /> <br />San <br /> <br />Marcos, <br /> <br />Texas, <br /> <br />a <br /> <br />municipal <br /> <br />corporation <br /> <br />organized <br /> <br />and <br /> <br />existing <br /> <br />under <br /> <br />the <br /> <br />laws <br /> <br />of <br /> <br />the <br /> <br />State <br /> <br />of <br /> <br />Texas, <br /> <br />acting under authority conferred on its Mayor, Kathy 11. <br /> <br />Morris, <br /> <br />hereinafter <br /> <br />referred <br /> <br />to <br /> <br />as <br /> <br />"Lessor" <br /> <br />and <br /> <br />John <br /> <br />J. <br /> <br />Stokes, <br /> <br />Sr., <br /> <br />hereinafter referred to as "Lessee", do hereby agree and contract <br /> <br />to add the following provision as a substitute for paragraph 3 and <br /> <br />to add other provisions as follows to paragraph 14 of the lease <br /> <br />agreement <br /> <br />adopted <br /> <br />on <br /> <br />July <br /> <br />28, <br /> <br />198ó <br /> <br />and <br /> <br />modified <br /> <br />by <br /> <br />the <br /> <br />City <br /> <br />Council of the City of San Marcos on August 25, 1986, to reflect a <br /> <br />new term, which shall remain in full for~e and effect. <br /> <br />3. <br /> <br />Term of Lease. <br /> <br />The <br /> <br />primary <br /> <br />term <br /> <br />of <br /> <br />this <br /> <br />lease <br /> <br />for <br /> <br />the <br /> <br />property <br /> <br />heretofore described in paragraph 1 shall be for a term of twenty <br /> <br />(2:ð) years beginning the 1st day of September, 1986, and running <br /> <br />through the 31st day of August, 2JJ6. <br /> <br />Lessae, if not in default <br /> <br />shall have the option of renewing <br /> <br />this lease two <br /> <br />(2) <br /> <br />additional <br /> <br />five ( 5 ) <br /> <br />year periods. <br /> <br />The lease payment for each five (5) year <br /> <br />period shall be calculated as detailed in paragraph four (4) <br /> <br />and <br /> <br />five (5) herein. <br /> <br />14. <br /> <br />Operations of the Airport. <br /> <br />o. <br /> <br />The <br /> <br />right <br /> <br />to <br /> <br />conduct <br /> <br />aeronautical <br /> <br />activities <br /> <br />for <br /> <br />furnishing services to the public is granted the Lessee subject to <br /> <br />Lessee agreeing: <br /> <br />(1) <br /> <br />to furnish said services on a fair, equal and nct <br /> <br />unjustly discriminatory basis to all users thereof, and <br /> <br />-1- <br />
