76

c:rTY C)F S/iN MARCOS

Office of
City Secretary

February 16, 1990

To:

Mayor Kathy Morris and Council Members

Pursuant to Section 6.02, Power of Referendum, of the Charter of
the City of San Marcos, a Referendum Petition may be presented
within 30 days after the effective date of an Ordinance which is
subject to referendum. Section 6.02 of the Charter requires the
petition to contain at least 10 percent of the qualified voters
voting in the last regular city election or 250, whichever is
greater. In the May 6, 1989 Regular Election there were 1,662
votes cast (10% = 166), which would require a petition to have
250 qualified signatures to be valid.

On February 14, 1990, a Referendum Petition was filed with me
regarding an Ordinance adopted by the City Council on January 22,
1990 pertaining to the creation of Reinvestment Zone No.5
requesting repeal of the Ordinance or submission to the voters.
Pursuant to Section 6.05, Filing, Examinination and Certification
of Petitions, of the Charter, I have certified this 16th day of
February, 1990, said Petition as having 293 qualified signatures
and as being sufficient.

f~o;;r~

City Secretary

-jkw
cc:

Mr. Larry Gilley
Mr. Mark Taylor
Mr. Pat Price
Mr. R.
