<br />76 <br /> <br />c:rTY C)F S/iN MARCOS <br /> <br />Office of <br />City Secretary <br /> <br />February 16, 1990 <br /> <br />To: <br /> <br />Mayor Kathy Morris and Council Members <br /> <br />Pursuant to Section 6.02, Power of Referendum, of the Charter of <br />the City of San Marcos, a Referendum Petition may be presented <br />within 30 days after the effective date of an Ordinance which is <br />subject to referendum. Section 6.02 of the Charter requires the <br />petition to contain at least 10 percent of the qualified voters <br />voting in the last regular city election or 250, whichever is <br />greater. In the May 6, 1989 Regular Election there were 1,662 <br />votes cast (10% = 166), which would require a petition to have <br />250 qualified signatures to be valid. <br /> <br />On February 14, 1990, a Referendum Petition was filed with me <br />regarding an Ordinance adopted by the City Council on January 22, <br />1990 pertaining to the creation of Reinvestment Zone No.5 <br />requesting repeal of the Ordinance or submission to the voters. <br />Pursuant to Section 6.05, Filing, Examinination and Certification <br />of Petitions, of the Charter, I have certified this 16th day of <br />February, 1990, said Petition as having 293 qualified signatures <br />and as being sufficient. <br /> <br />f~o;;r~ <br /> <br />City Secretary <br /> <br />-jkw <br />cc: <br /> <br />Mr. Larry Gilley <br />Mr. Mark Taylor <br />Mr. Pat Price <br />Mr. R.
