<br />SUPPLEMENTAL AGREEMENT NO.2
<br />
<br />THIS SUPPLEMENTAL AGREEMENT, made and entered into this~~ 7 th
<br />day of February 1990, by and between the CITY OF SAN MARCOS,
<br />TEXAS, whose address is City Hall, 630 East Hopkins, San Marcos,
<br />Texas 78666, for itself, its successors, and assigns, hereinafter called
<br />the Lessor, and the UNITED STATES OF AMERICA, represented by the Federal
<br />Aviation Administration, hereinafter referred to as the Government,
<br />WITNESSETH, That:
<br />
<br />WHEREAS, on the 1st day of February, 1985, the parties hereto entered
<br />into Lease No. DTFA07-85-L-OI095 , as amended by Supplemental Agreement
<br />No.1 dated December 19, 1985, for the consideration and purposes more
<br />particularly stated in said lease, as amended; and
<br />
<br />WHEREAS, the Government has a requirement to install an Automated
<br />Weather Observing/Reporting System (AWOS) at the glide slope for
<br />Runway 12, as shown on Exhibit "A," Drawing No. SW-D-993l-lA, Revised
<br />June 28,1989, Exhibit "B," Drawing No. SW-D-l0982-4, and Exhibit "C,"
<br />Drawing No. SW-D-l0982-9, attached hereto and made a part hereof; and
<br />
<br />WHEREAS, the Government has a need to amend Article 15 of the lease to
<br />reflect a new mowing height of vegetation, and to specify times for mowing
<br />and maintenance of clear zones.
<br />
<br />NOW, THEREFORE, effective February 27, f990the parties hereto mutually
<br />agree to amend the basic lease, as amended, in the following particulars
<br />only, VIZ:
<br />
<br />1. The Lessor shall provide the Government additional land at the
<br />Runway 12 glide slope for installation of an AWOS as more particularly
<br />shown on Exhibit "A," Drawing No. SW-D-9931-lA, Revised June 28, 1989,
<br />Exhibit liB," Drawing No. SW-D-l0982-4, and Exhibit "C,II Drawing
<br />No. SW-D-10982-9, attached hereto and made a part hereof; and
<br />
<br />2. Article 15 of this lease is deleted in its entirety and the
<br />following substituted therefor:
