<br /> 8~:O 7~O -8- <br /> 0 oJ; 'J <br /> virtue of this agreement will be recaptured, the Tax <br /> Abatement will be rescinded and the amount of previously <br /> Abated Taxes shall be paid by Parkview to the City <br /> within sixty (60) days of the termination. <br /> 2. If the City Council determines that Parkview has failed to <br /> create the cummulative number of jobs specified in Part II <br /> to be created by either the December 31, 1992 or December <br /> 31, 1993 deadlines, then for each job less than the number <br /> required to be created by a particular deadline, Parkview <br /> shall be required to pay the City an amount of money equal <br /> to a fractional part of the cumulative amount of Abated <br /> Taxes under this Agreement at the time a default is <br /> declared by the City Council, with the fraction consisting <br /> of one (I) as the numerator, and the number of cumulative <br /> jobs to be created by the respective deadline as the <br /> denominator. <br /> E. If pursuant to subsection A, the City declares that Parkview <br /> is in default with respect to this Agreement and <br /> thereafter the City terminates this Agreement, in whole or <br /> in part, the City shall be entitled to collect from <br /> Parkview the full value of all fee waivers provided for in <br /> part VI, below. The City shall be entitled to and receive <br /> a lien against the Property to secure the full value of <br /> the fees so waived. <br />
