<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
<br />OF SAN MARCOS, TEXAS AMENDING THE CITY BUDGET
<br />ORDINANCE FOR THE 1989-199Ø FISCAL YEAR
<br />(ORDINANCE 1989-38) TO PROVIDE FUNDING FOR
<br />FUEL STORAGE TANK CLEANUP COSTS, MULTI-PURPOSE
<br />SOCCER FIELD CONSTRUCTION, ACQUISITION OF
<br />PROPERTY FROM THE NATURE CONSERVANCY, THE
<br />INSTALLATION OF PLAYGROUND EQUIPMENT, AND
<br />AIRPORT TERMINAL CONSTRUCTION; AND DECLARING
<br />AN EMERGENCY.
<br />
<br />WHEREAS, after publ ication of notice on July 3Ø, 1989, the City
<br />Council of the City of San Marcos, Texas, held a public hearing on
<br />August 14, 1989, on the budget proposed by the City ~lanager for said
<br />City for the fiscal year beginning October 1, 1989; and,
<br />
<br />WHEREAS, at the public hearing all interested persons were given
<br />an opportunity to be heard for or against any item or the amount of any
<br />item therein contained; and,
<br />
<br />WHEREAS, after this public hearing, the City Council adopted the
<br />budget for the City for the fiscal year beginning October 1, 1989 and
<br />ending on September 30, 199Ø, on September 11, 1989; and,
<br />
<br />WHEREAS, this budget set forth itemized estimates of the expense
<br />of conducting the San Marcos municipal government for that fiscal year
<br />and appropriated money for the various funds and purposes of such
<br />estimate; and,
<br />
<br />~'VHEREAS, in accordance with Section 8.16 of the City Charter of
<br />the City of San Marcos, Texas, the City Council declares that a public
<br />necessity exists which requires amendment of the budget; now,
<br />therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS,
<br />TEXAS:
<br />
<br />SECTION 1. That that the City Budget Ordinance for the 1989-199Ø
<br />Fiscal Year (Ordinance 1989-38) is hereby amended as set forth in the
<br />attached Exhibits A, B, C, D and E in order to provide funding for fuel
<br />storage tank cleanup costs, multi-purpose soccer field construction,
<br />acquisition of property from the Nature Conservancy, installation of
<br />playground equipment, and airport terminal construction, respectively.
<br />
<br />SECTION 2. That these revisions and reappropriations which shall
<br />be the amended budget for the City of San Marcos, Texas, for the fiscal
<br />year 1989-199Ø beg inning October 1, 1989 and ending on September 30,
<br />199Ø, are hereby approved and adopted.
<br />
<br />SECTION 3. That the importance of this Ordinance creates an
<br />emergency and an imperative public necessity so that the provisions of
<br />the Charter requiring that ordinances shall be presented at three
<br />separate meetings and that no ordinance shall become effective until
<br />the expiration of ten (10) days following the date of its final passage
<br />be suspended, and these provisions are hereby suspended, and this
<br />Ordinance shall take effect and be in full force and effect from and
<br />after its adoption and after its publication in a newspaper of general
<br />circulation in the area as required by the Charter of the City of San
<br />Marcos.
