Box 171 <br /> San Marcos, TX 78666 <br /> To Alma Briggs: <br /> This Ie tter upon its execution by the San Marcos Area Food Bank shal1 <br /> constitute the agreement between the City of San Marcos, Texas (City) <br /> and the San Marcos Area Food Bank, a non-profit corporation, (Food <br /> Bank), for the Food Bank's use of a 1980 Ford F150 pickup truck, <br /> vehicle identification number FI5EPJD3222, License No. 376-399, (the <br /> Vehicle), for the purpose of collecting donated food and distributing <br /> the same to needy citizens in the San Marcos area. For and in <br /> consideration of the previously stated service to the public provided <br /> by the Food Bank, the City does hereby grant to the Food Bank the right <br /> to use the above vehicle in its Food Bank operations upon the following <br /> terms and conditions: <br /> 1. Ownership of the vehicle shall remain with the City throughout <br /> the term of this Agreement. <br /> 2. The City maintain liability in9urance on the Vehicle throughout <br /> the term of this agreement. The Food Bank agrees to cooperate <br /> fully with the City's insurer in all matters pertaining <br /> to such insurance and the Vehicle. <br /> 3. The Food Bank will pay for all fuel, oil and maintenance, <br /> repairs and upkeep of the Vehicle necessary to its proper and <br /> lawful operation, and will surrender the Vehicle and all <br /> keys thereto to the City upon the termination of this Agreement <br /> in as good condition (normal wear and tear excepted) as <br /> when the Food Bank acquired possession of the Vehicle. <br /> 4. The Food Bank will furnish the City copies of all invoices, bills <br /> and other written records documenting any maintenance performed <br /> on the Vehicle during the term of this Agreement. <br /> 5. The Food Bank, its employees and agents agree to operate and <br /> use the Vehicle in compliance with all applicable laws, <br /> ordinances, codes, rules and regulations of all local, state and <br /> federal governments. <br /> eo <br /> , <br />
