<br /> 4~ (/ A " <br /> SETTLEMENT AGREEMENT <br /> STATE OF TEXAS ) <br /> COUNTY OF HAYS ) <br /> 1. BACKGROUND <br /> This agreement is made and entered into by and between <br /> the City of San Marcos, Texas, a municipal corporation <br /> operating pursuant to Texas Law and a home rule charter, its <br /> assigns, successors, and transferees, whether in whole or in <br /> part, hereinafter referred to as "City" and Crystal Clear Water <br /> Supply Corporation, duly incorporated under the Laws of the <br /> State of Texas, its assigns, successors, and transferees, <br /> whether in whole or in. part hereinafter referred to as "Crystal <br /> Clear." The purpose of this agreement is to settle each <br /> party's respective rights as to that overlapping portion of <br /> territory in which both parties have an approved certified <br /> water service area hereinafter referred to as the "dual <br /> certified service area". <br /> II. AGREEMENTS OF BOTH THE CITY AND CRYSTAL CLEAR: <br /> Both the City and Crystal Clear agree to: <br /> ( 1) Continue service to any presently existing <br /> customers within the dual certified service <br /> area, including any new customers which apply <br /> to be hooked-up or serviced by either party <br /> from the then presently existing water lines, <br /> without adding to or extending any such <br /> presently existing water line. <br />
