Mr. Farr then moved the Ordinance be adopted on emergency and Mr. Guerra seconded the motion, which passed unanimously. Iv1ayor Craddock introduced for consideration approval of an Ordinance on first reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN Iv1ARCOS, TEXAS, ABANDONING AND VACATING A PORTION OF AN ALLEY AND A PORTION OF NEVADA STREET IN THE Z. WILLIAMSON THIRD ADDITION TO THE CITY OF SAN Iv1ARCOS, TEXAS; PROVIDING FOR THE REVERSION OF FEE IN SAID LAND AND DECLARING AN EFFECTIVE DATE. Ms. Kissler moved for approval of the Ordinance on first reading and Mr. Farr seconded the motion. Mr. John Stokes wants to construct drainage improvements (which have been approved by the Public Works Department) in exchange for the abandonment. The appraised value of the property is $2,200.00. Mr. Stokes said he will give a portion of Nevada Street back to the City in the form of an easement. Mr. Stokes requested the City Attorney give his legal opinion regarding the City abandoning and the property reverting to the owner, and the Council directed Mr. Chapman provide this opinion. The Council voted unanimously for approval of the Ordinance on first reading. CAUDILLO; AUTHORIZING THE Iv1AYOR TO EXECUTE A WARRANTY DEED TO ISABEL P. CAUDIL- LO AND DECLARING AN EFFECTIVE DATE. Mr. Guerra moved for approval of the Ordinance on first reading and Iv1r. Kreczmer seconded the motion, which passed unanimously.
