<br /> -4- <br /> Hays County Sheriff and the San Marcos Chief of Police. Should this <br /> fund reach a level exceeding the requirements of Task Force operations, <br /> the surplus amount shall be divided equally between the Sheriff's <br /> Department and the Police Department. <br /> (d) All funds created under this Agreement shall be kept and <br /> administered by the Task Force. All financial records of these funds <br /> shall be subject to audit and review by the County Auditor or the San <br /> Marcos Finance Director upon demand. At the end of each fiscal year, <br /> the external auditor of either Hays County or San Marcos shall prepare <br /> a written audit of all of these funds and prepare a report for the <br /> governing bodies of Hays County and San Marcos. The parties shall <br /> alternate these annual audits, but each retains the right to conduct <br /> its own audit. <br /> 10. TERM AND TERMINATION: <br /> (a) Subject to the availability of funding for this Agreement <br /> through the annual budget processes of Hays County and San Marcos, this <br /> agreement shall remain in force and effect for annual periods effective <br /> each May 1st unless either party gives the other party written notice <br /> of its intention to terminate this agreement at least 90 days in <br /> advance of an anniversary of that date. <br /> (b) Upon any termination of this Agreement, all outstanding Task <br /> Force expenses shall be paid in accordance with Section 9 of this <br /> Agreement and any remaining balances of the Task Force Operating Fund <br /> and Forfeiture Fund shall be divided equally between the Sheriff's <br />
