<br /> 160 <br /> AN AGREEMENT CONCERNING PROVISIONS <br /> OF EMERGENCY MEDICAL SERVICES <br /> STATE OF TEXAS <br /> COUNTY OF HAYS <br /> This Agreement is made by and between THE CITY OF SAN MARCOS, <br /> TEXAS (City), a Texas municipal corporation, the COUNTY OF HAYS, <br /> TEXAS, (County), and the SAN MARCOS/HAYS COUNTY EMERGENCY MEDICAL <br /> SERVICES, INCORPORATED (EMS), a Texas non profit corporation, <br /> pursuant to the authority and terms of Vernon's Annotated Texas <br /> Statutes article 4413 (32c) (Interlocal Cooperation Act). <br /> I. <br /> The purpose of this Agreement is to provide high quality <br /> emergency medical services at reasonable costs for the residents of <br /> City and County. <br /> II. <br /> EMS and City agree to furnish equipment and personnel as <br /> necessary to provide first class emergency medical services for the <br /> residents of County and City. At no time, however, shall service <br /> hereunder include fewer than two properly functioning and fully <br /> equipped emergency medical service vehicles supplied by EMS, one of <br /> which shall be staffed by EMS with one paramedic and one emergency <br /> medical technician, and the other staffed by EMS with one "on call" <br /> paramedic and by City with one emergency medical technician, all <br /> trained and certified in accordance with the laws of the State of <br /> Texas. <br /> EMS agrees that it shall use its best efforts at all times to <br /> maintain its status as a tax exempt non profit corporation pursuant <br />
