<br /> 164 <br /> RESOLUTION 1990- 43 R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, SETTING A PUBLIC HEARING TO CONSIDER <br /> ADOPTION OF A CAPITAL IMPROVEMENTS PLAN AND IMPOSITION <br /> OF AN IMPACT FEE; AND DECLARING AN EFFECTIVE DATE. <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> PART 1. That a public hearing will be held by the City of San <br /> Marcos City Council at a special meeting on Monday, May 21, 1990, at <br /> 7:30 p.m. in the City Council Chambers of City Hall, 630 East Hopkins <br /> Street, for the purpose of considering adoption of impact fees for <br /> water and wastewater system improvements and expansions based upon a <br /> capital improvements plan for the next ten years. The service area <br /> within which the proposed impact fees will be levied is the corporate <br /> limits of the City of San Marcos, as indicated on the map attached to <br /> this Resolution. The service area will include any additional areas as <br /> they are annexed by the City of San Marcos. <br /> If adopted, the proposed impact fees will replace the capital <br /> recovery fees currently assessed by the City of San Marcos. The <br /> proposed water utility impact fee is $363 per service unit (previously <br /> known as living unit equivalent, or l.u.e.). The current water utility <br /> capital recovery fee is $1,100 per service uni t. The proposed <br /> wastewater impact fee is $527 per service unit. The current wastewater <br /> capital recovery fee is $900 per service unit. <br /> PART 2. That any member of the public has the right to appear at <br /> the hearing and present evidence for or against the capital <br /> improvements plan and proposed impact fees. <br /> PART 3. That the publ ica tion, prior to the adoption of this <br /> Resolution of any notices pertaining to this public hearing in <br /> accordance with applicable State law is hereby ratified. <br /> PART 4.
