<br />-., <br />¿¡¿ 28 <br />'S;- <br />"-- <br />~' <br /> <br /> <br />ORDINANCE 199Ø - 35 <br /> <br /> <br />~~ AN ORDINANCE OF THE CITY COUNCIL OF THE <br />~ CITY OF SAN MARCOS, TEXAS AMENDING <br />~ CHAPTER 29-111 OF THE SAN MARCOS CODE OF <br />ORDINANCES TO ADD A NO PARKING ZONE ON <br />GUADALUPE STREET~ PROVIDING FOR <br />SEVERABILITY~ REPEALING ALL CONFLICTING <br />ORDINANCES: PROVIDING A PENALTY: <br />PROVIDING FOR PUBLICATION AND DECLARING <br />AN EFFECTIVE DATE. <br /> <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />Section 1: That Section 29-111 of the San Marcos Code of <br />Ordinances is amended to add the following portion of street, <br />codified in alphabetical order, upon which parking shall be <br />prohibited: <br /> <br />Guadal upe Street, east side, from a point ninety (9Ø) <br />feet south of its intersection with University Street <br />to Hutchison Street <br /> <br />Section 2: That, pursuant to Section 29-147 of the San <br />Marcos Code of Ordinances, the Chief of Police is hereby <br />authorized to maintain and mark three (3) parking spaces limited <br />to use for periods of not more than fifteen (15) minutes on the <br />East side of Guadalupe Street as shown on the attached map. No <br />person shall park a vehicle within any of these spaces for a <br />period of time longer than fifteen (15) minutes. <br /> <br />Section 3: That if any word, phrase, clause, sentence, or <br />paragraph of this ordinance is held to be unconstitutional or <br />invalid by a court of competent jurisdiction, the remaining <br />provisions of this ordinance shall remain in effect as if the <br />unconstitutional or invalid portion had not been adopted. <br /> <br />Section 4: That all ordinances or parts of ordinances in <br />conflict with this ordinance are hereby repealed. <br /> <br />Section 5: That any person who violates any provision of <br />this ordinance shall be deemed guilty of a misdemeanor and upon <br />conviction shall be subj ect to the penalty prescribed in Section <br />1-5 of the San Marcos Code of Ordinances. <br /> <br />Section 6: That this Ordinance shall be in effect ten (lØ) <br />days from and after its passage, and it shall be published in a <br />newspaper of general circulation in the area as required by the <br />Charter of the City of San Marcos, Texas, <br /> <br />PASSED AND APPROVED on first reading April 9, 1990. <br /> <br />PASSED AND APPROVED on second reading April 23, 1990. <br /> <br />PASSED.
