<br />115 <br />Special Meeting December 19, 1983 Page 2 <br />Mr. Brown moved for approval of the Ordinance on first reading and <br />Mr. Moore seconded the motion, which passed unanimously. <br />Mayor Craddock introduced for consideration the adoption of an Ordin- <br />ance on third and final reading, the caption which was read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, ANNEXING TO SAID CITY A TRACT OF LAND <br /> CONTAINING 1.1 ACRE, MORE OR LESS, OUT OF THE J. M. <br /> VERAMENDI SURVEY NO. 2, IN HAYS COUNTY, TEXAS, SAID <br /> TRACT BEING LOCATED WITHIN THE EXTRATERRITORIAL JURIS- <br /> DICTION OF SAID CITY AND LYING ADJACENT TO PRESENT <br /> CITY BOUNDARIES; APPROVING A SERVICE PLAN FOR SAID <br /> TRACT; EXTENDING THE BOUNDARY LIMITS OF SAID CITY SO <br /> AS TO INCLUDE SAID TRACT; GRANTING TO THE INHABITANTS <br /> OF SAID TRACT ALL THE RIGHTS AND PRIVILEGES AND OTHER <br /> CITIZENS OF SAID CITY; BINDING SAID INHABITANTS BY ALL <br /> OF THE ACTS AND ORDINANCES, RULES AND REGULATIONS OF <br /> SAID CITY AND DECLARING AN EFFECTIVE DATE. <br />Mr. Kreczmer moved for adoption of the Ordinance and Mr. Guerra second- <br />ed the motion, which passed unanimously. <br />Mayor Craddock introduced for consideration the adoption of an Ordin- <br />ance on third and final reading, the caption which was read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, ANNEXING TO SAID CITY A TRACT OF LAND <br /> CONTAINING 47.24 ACRES OF LAND, MORE OR LESS, IN THE <br /> BENJAMIN J. Mr. Kreczmer then moved to table the adoption of the Or- <br />dinance because of the concerns raised in Acting City Attorney Charles <br />Chapman's memorandum to the Council dated December 16, 1983. Mr. Chap- <br />man advised the Council the City did not own the sewage system, as it <br />had not yet been accepted by the City from San Marcos Baptist Academy. <br />City Manager Gonzalez stated this was in his opinion an administrative <br />problem that could be worked out by the Staff. He reminded the Council <br />before construction would commence on the property it would still have <br />to be zoned and platted. Public Works Director George Boeker stated <br />we had inspected the line and it would just be a formality to receive <br />the Baptist Academy's engineer's certification. Developer and owner <br />of the property, Ken Kraus said he was aware of the possible costs he <br />would incur in developing this property and wanted the Council to pro- <br />ceed. Mr. Brown stated he was in favor of the Council adopting this <br />Ordinance. Mr. Kreczmer then withdrew his tabling motion. The Council <br />voted unanimously for adoption of the Ordinance. <br />
