115 Special Meeting December 19, 1983 Page 2 Mr. Brown moved for approval of the Ordinance on first reading and Mr. Moore seconded the motion, which passed unanimously. Mayor Craddock introduced for consideration the adoption of an Ordin- ance on third and final reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, ANNEXING TO SAID CITY A TRACT OF LAND CONTAINING 1.1 ACRE, MORE OR LESS, OUT OF THE J. M. VERAMENDI SURVEY NO. 2, IN HAYS COUNTY, TEXAS, SAID TRACT BEING LOCATED WITHIN THE EXTRATERRITORIAL JURIS- DICTION OF SAID CITY AND LYING ADJACENT TO PRESENT CITY BOUNDARIES; APPROVING A SERVICE PLAN FOR SAID TRACT; EXTENDING THE BOUNDARY LIMITS OF SAID CITY SO AS TO INCLUDE SAID TRACT; GRANTING TO THE INHABITANTS OF SAID TRACT ALL THE RIGHTS AND PRIVILEGES AND OTHER CITIZENS OF SAID CITY; BINDING SAID INHABITANTS BY ALL OF THE ACTS AND ORDINANCES, RULES AND REGULATIONS OF SAID CITY AND DECLARING AN EFFECTIVE DATE. Mr. Kreczmer moved for adoption of the Ordinance and Mr. Guerra second- ed the motion, which passed unanimously. FORSYTH SUR- VEY AND THE LYDIA GLASCOW SURVEY IN HAYS COUNTY, TEXAS, SAID LAND BEING LOCATED WITHIN THE EXTRATER- RITORIAL JURISDICTION OF SAID CITY AND LYING ADJA- CENT TO PRESENT CITY BOUNDARIES; APPROVING A SERVICE PLAN FOR SAID TRACT; EXTENDING THE BOUNDARY LIMITS OF SAID CITY SO AS TO INCLUDE SAID TRACT; GRANTING TO THE INHABITANTS OF SAID TRACT ALL THE RIGHTS AND PRIVILEGES OF OTHER CITIZENS OF SAID CITY; BINDING SAID INHABITANTS BY ALL OF THE ACTS AND ORDINANCES, RULES AND REGULATIONS OF SAID CITY AND DECLARING AN EFFECTIVE DATE. Mr. Farr moved for adoption of the Ordinance and Mr. Brown seconded the motion. Mr. Kreczmer then moved to table the adoption of the Or- dinance because of the concerns raised in Acting City Attorney Charles Chapman's memorandum to the Council dated December 16, 1983. Mr. Chap- man advised the Council the City did not own the sewage system, as it had not yet been accepted by the City from San Marcos Baptist Academy. City Manager Gonzalez stated this was in his opinion an administrative problem that could be worked out by the Staff. He reminded the Council before construction would commence on the property it would still have to be zoned and platted. Public Works Director George Boeker stated we had inspected the line and it would just be a formality to receive the Baptist Academy's engineer's certification. Developer and owner of the property, Ken Kraus said he was aware of the possible costs he would incur in developing this property and wanted the Council to pro- ceed. Mr. Brown stated he was in favor of the Council adopting this Ordinance. Mr. Kreczmer then withdrew his tabling motion. The Council voted unanimously for adoption of the Ordinance.
