40 STATE OF TEXAS X PURCHASE CONTRACT CITY OF SAN MARCOS COUNTY OF HAYS X PARCEL NO. 1 1. AGREEMENT: The undersigned, herein called Owners, whether one or more, for a good and valuable consideration the receipt of which is hereby acknowledged, agree to sell to the City of San Marcos, a municipal corporation situated in Hays County, Texas, or its assigns, and the City of San Marcos agrees to purchase for the consideration and upon the terms herein stated, the property described below. 2. PROPERTY DESCRIPTION: Ten (lØ') feet off of the front of Lot(s) 1 in Guerrero's Resubdivision of the Southwest 1/2 of Tract 3, Weatherford Subdivision, Volume 146, Page 639, Hays County deed Records, 3, CONTRACT PRICE: $ 10,690.00 shall be paid by the City for fee simple title to such property, free of all liens and encumbrances including ~urrent taxes. 4. TITLE: The City agrees to prepare the deed to the property at no expense to the Owners and to pay the cost of title insurance, if the City deems such insurance to be necessary, 5. CLOSING/POSSESSION: Owners hereby agree to surrender possession of the property to the City at the time of closing. 6, OTHER CONDITIONS: Owners agree to convey to the City fee simple title to the above-described property for the consideration herein stated, or whatever interest therein found to be owned by the Owners for a proportionate part of the above consideration. The City agrees that upon delivery of the properly executed deed, it will pay Owners the above-stated amount or the proportionate part of the above consideration for whatever interests Owners may have.
