<br /> -l2- <br /> ( l) have the lowest floor (including basement) elevated above <br /> the highest adjacent grade at least as high as the depth <br /> number specified in feet on the community's FIRM (at least <br /> two (2) feet if no depth number is specified); or <br /> (2) together with attendant utility and sanitary facilities be <br /> designed so that below the base flood level the structure is <br /> watertight with walls substantially impermeable to the <br /> passage of water and with structural components having the <br /> capability of resisting hydrostatic and hydrodynamic loads <br /> or effects of buoyancy. <br />(c) A registered professional engineer or architect shall submit a <br /> certification to the floodplain administrator that the standards <br /> of this section are satisfied. <br />(d) Within zones AH or AO, adequate drainage paths shall be required, <br /> around structures on slopes, to guide flood waters around and <br /> away from proposed structures. <br />Sec. 5-67 Floodvays. <br /> <br /> Located within areas of special flood hazard are areas designated <br />as floodways. Since the floodway is an extremely hazardous area due <br />to the velocity of flood waters which carry debris, potential <br />projectiles and erosion potential, the following provisions shall <br />apply: <br />(a) Encroachments are prohibited, including fill, new construction, <br /> substantial improvements and other developments unless <br /> certification by a professional registered engineer is provided <br /> demonstrating that encroachments shall not result in any increase <br /> in flood levels within the jurisdiction during the occurrence of <br /> the base flood discharge. <br />(b) If section 5-67(a) above is satisfied, all new construction and <br /> substantial improvements shall comply with all applicable flood <br /> hazard reduction provisions of this article. <br />Sec. 5-68 Existing structures. <br /> <br /> Structures and uses of structures which lawfully exist prior to <br />adoption of these standards and which do not conform with their <br />provisions, may be continued subject to the following conditions: <br />(a) Existing structures and uses within a floodway shall not be <br /> expanded or enlarged unless the effect of proposed expansion or <br /> enlargement does not cause an additional increase in floodway <br /> elevation during the occurrence of the base flood discharge, as <br /> certified by a registered professional engineer. <br />(b) Any repair, reconst:=uction or improvement of an existing <br /> structure within a floodplain which constitutes substantial <br /> improvement shall be undertaken only in full compliance with this <br /> article, and the owner shall be required to obtain a floodplain <br /> permit before repair, reconstruction or improvement shall begin. <br /> SECTION 2. Until such time as the Flood Insurance Study, with <br />accompanying maps, referred to in Sec. 5-52 of the San Marcos Code of <br />Ordinances, becomes effective on September 5, 1990, areas of special <br />flood hazard within the City shall be those identified by the Federal <br />Emergency Management Agency in a scientific and engine,aring report <br />entitled, "The Flood Insurance Study for San Marcos, Texas," dated <br />Septt~mber, 1983. <br /> SECTION 3. That if any word, phrase, clause, sentence, or <br />paragraph of this ordinance is held to be unconstitutional or invalid <br />by a court of competent jurisdiction, the remaining provisions of this <br />ordinance shall remain in effect as if the unconstitutional or invalid <br />portion had not been adopted. <br /> SECTION 4. That all ordinances or parts of ordinances in <br />conflict with this ordinance are hereby repealed. <br />
