ORDINANCE NO. 2013-39 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 495.23 ACRE, MORE OR LESS, TRACT OF LAND, OUT OF THE JOHN H. YEARBY SURVEY, ABSTRACT NO. 508, COMMONLY KNOWN AS THE GASLAMP PROJECT, LOCATED AT THE NORTHWEST CORNER OF OLD BASTROP HIGHWAY AND CENTERPOINT ROAD FROM "FD" FUTURE DEVELOPMENT DISTRICT TO "SC" SMARTCODE DISTRICT; DESIGNATING 61.163 ACRES, MORE OR LESS, WITHIN SUCH TRACT OF LAND AS A SPECIAL DISTRICT FOR RESEARCH AND LIGHT INDUSTRIAL USES; AND INCLUDING PROCEDURAL PROVISIONS. RECITALS: 1. On June 25, 2013, the Planning and Zoning Commission of the City of San Marcos held a public hearing regarding a request to rezone a 495.23 acre, more or less, tract of land, out of the John H. Yearby Survey, Abstract No. 508, located at the northwest corner of Old Bastrop Highway and Centerpoint Road from "FD" Future Development District to "SC" SmartCode District. 2. Subsequent to the public hearing on that date, the Planning and Zoning Commission voted to recommend that the rezoning request be approved by the City Council of the City. 3. In connection with the rezoning request, the applicant has also made request to designate 61.163 acres, more or less, within said 495.23 acre tract of land as a Special District for research and light industrial uses. 4. The City Council held a public hearing on August 6, 2013 regarding the rezoning request and the request for a Special District designation. 5. All applicable requirements of the San Marcos SmartCode and the City's Land Development Code pertaining to Zoning Map amendments have been met. 6. The City Council hereby finds and determines that the adoption of the following ordinance is in the interest of the public health, morals, welfare and safety. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION L The Official Zoning Map of the City, as described in Section 4.1.2.2 of the City Land Development Code, is amended to rezone the following tract of real property from "FD" Future Development District to "SC" SmartCode District: Street address: Northwest corner of Old Bastrop Highway and Centerpoint Road.
