ORDINANCE NO. 2013-39 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS AMENDING THE OFFICIAL ZONING MAP OF THE <br />CITY BY REZONING A 495.23 ACRE, MORE OR LESS, TRACT OF <br />LAND, OUT OF THE JOHN H. YEARBY SURVEY, ABSTRACT NO. 508, <br />COMMONLY KNOWN AS THE GASLAMP PROJECT, LOCATED AT <br />THE NORTHWEST CORNER OF OLD BASTROP HIGHWAY AND <br />CENTERPOINT ROAD FROM "FD" FUTURE DEVELOPMENT <br />DISTRICT TO "SC" SMARTCODE DISTRICT; DESIGNATING 61.163 <br />ACRES, MORE OR LESS, WITHIN SUCH TRACT OF LAND AS A <br />SPECIAL DISTRICT FOR RESEARCH AND LIGHT INDUSTRIAL <br />USES; AND INCLUDING PROCEDURAL PROVISIONS. <br />RECITALS: <br />1. On June 25, 2013, the Planning and Zoning Commission of the City of San Marcos <br />held a public hearing regarding a request to rezone a 495.23 acre, more or less, tract of land, out <br />of the John H. Yearby Survey, Abstract No. 508, located at the northwest corner of Old Bastrop <br />Highway and Centerpoint Road from "FD" Future Development District to "SC" SmartCode <br />District. <br />2. Subsequent to the public hearing on that date, the Planning and Zoning Commission <br />voted to recommend that the rezoning request be approved by the City Council of the City. <br />3. In connection with the rezoning request, the applicant has also made request to <br />designate 61.163 acres, more or less, within said 495.23 acre tract of land as a Special District <br />for research and light industrial uses. <br />4. The City Council held a public hearing on August 6, 2013 regarding the rezoning <br />request and the request for a Special District designation. <br />5. All applicable requirements of the San Marcos SmartCode and the City's Land <br />Development Code pertaining to Zoning Map amendments have been met. <br />6. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION L The Official Zoning Map of the City, as described in Section 4.1.2.2 of the <br />City Land Development Code, is amended to rezone the following tract of real property from <br />"FD" Future Development District to "SC" SmartCode District: <br />Street address: Northwest corner of Old Bastrop Highway and Centerpoint Road. <br />
