The State of Texas <br />County of Hays <br />INTERLOCAL AGREEMENT <br />BETWEEN THE CITY OF SAN MARCOS, TEXAS AND COUNTY OF HAYS, TEXAS <br />2013 BYRNE JUSTICE ASSISTANCE GRANT (JAG) PROGRAM AWARD <br />This Agreement is made and entered into this day of July , 2013 (the "Effective Date ") by and <br />between the COUNTY of Hays, acting by and through its governing body, the Commissioners Court, <br />hereinafter referred to as COUNTY, and the CITY of San Marcos, acting by and through its governing <br />body, the City Council, hereinafter referred to as CITY, both of Hays County, State of Texas, witnesseth: <br />WHEREAS, the U.S. Department of Justice requires that entities in a disparate allocation of <br />Justice Assistance Grant (JAG) funding enter into an Agreement to provide for the use of those funds <br />awarded; and <br />WHEREAS, this Agreement is made under the authority of the Interlocal Cooperation Act, <br />Chapter 791 of the Texas Government Code, as amended: and <br />WHEREAS, each governing body, in performing governmental functions or in paying for the <br />performance of governmental functions hereunder, shall make that performance or those payments from <br />current revenues legally available to that party: and <br />WHEREAS, each governing body finds that the performance of this Agreement is in the best <br />interest of both parties, that the undertaking will benefit the public, and that the division of costs fairly <br />compensates the performing party for the services or functions under this agreement: and <br />WHEREAS, the CITY is eligible for $12,485 from the direct JAG award, and the COUNTY did <br />not qualify for a direct award in this disparate allocation; and <br />
