ORDINANCE NO. 2013-35 AN ORDINANCE OF THE CITY COUNCIL OF THE OF THE CITY OF SAN MARCOS, TEXAS AMENDING CHAPTERS 1 THROUGH 8 OF THE SAN MARCOS LAND DEVELOPMENT CODE TO IMPLEMENT THE CHANGES MADE THROUGH ORDINANCE 2013 -16 WHICH ADOPTED THE "VISION SAN MARCOS: A RIVER RUNS THROUGH US" COMPREHENSIVE PLAN; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR THE REPEAL OF ANY CONFLICTING PROVISIONS; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: RECITALS: 1. On April 16, 2013 the City Council adopted Ordinance 2013 -16 which adopted "Vision San Marcos: A River Runs Through Us" as the Comprehensive Plan ( "Plan ") to guide the growth and development of the City, adopted the Preferred Scenario Map as the Future Land Use Map and limited the consideration of requests for amendments to twice per year. 2. The City is now amending Chapters 1 through 8 of the Land Development Code in order to reflect the changes made through Ordinance 2013 -16, to implement the Plan as adopted. SECTION 1. Chapters 1 through 8 of the Land Development Code are amended as shown in Exhibit A, attached hereto and made a part hereof for all purposes. Amendments are indicated by red font, with deletions being indicated by strikethroughs. Added text is indicated by underlining. SECTION 2. In codifying the changes authorized by this ordinance, paragraphs, sections and subsections may be renumbered and reformatted as appropriate consistent with the numbering and formatting of the San Marcos Land Development Code. SECTION 3. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will continue in force if they can be given effect without the invalid portion. SECTION 4. All ordinances and resolutions or parts of ordinances or resolutions in conflict with this ordinance are repealed. SECTION 5. This ordinance will take effect after its passage, approval and adoption on second reading.
