For purposes of this Chapter 1, the term "construction permit” refers to any authorization to <br />construct, alter or place a structure on a lot, tract or parcel. The term excludes an authorization to construct a capital <br />improvement to be dedicated to the public in support of a proposed land use, the grading of land, the removal of <br />vegetation, and other activities authorized to prepare a development site for construction of a structure. <br />(b) Effect. Approval of a construction permit authorizes the property owner to place or construct the structure on the lot, <br />tract or parcel in accordance with the terms of the permit. Approval of a construction permit confirms that the <br />application conforms to all requirements of this Land Development Code pertaining to the construction of the <br />proposed structure. <br />(a) Prior Approvals. An application for a construction permit shall not be approved until the following petitions or <br />development applications, where applicable, have been approved and remain in effect for land for which the <br />application is made: <br />(1) All legislative applications needed to authorize the proposed uses for the land; <br />(2) All quasi - judicial applications; <br />(3) A Final Subdivision Plat or Final Development Plat; <br />(4) A Site Preparation Permit; and <br />(5) Any variance petition required for placement or construction of the structure on the lot, tract or parcel. <br />(b) Accompanying Applications. An application for a construction permit may be accompanied by an application for a <br />Site Preparation Permit, provided that the Site Preparation Permit is decided first. <br />(c) Rules of Priority Among Construction Permits. The following rules of priority apply among construction permits. <br />(1) A Floodplain Permit shall be approved prior to a building permit. <br />(2) A building permit shall be approved prior to a certificate of occupancy. <br />(3) Where a building permit is required, an application for a sign permit may accompany the application for a <br />building permit, provided that the building permit application is decided first. <br />San Marcos, Texas, Code of Ordinances Page 114 <br />
