Subpart B - LAND DEVELOPMENT CODE <br />Chapter 1 - DEVELOPMENT PROCEDURES <br />ARTICLE 9: - CONSTRUCTION PERMITS <br />DIVISION 3: - CERTIFICATES OF OCCUPANCY <br />(3) Where occupancy of a manufactured home rental community is proposed, the community has been designed <br />and constructed in conformity with the requirements of Chapter 4, Article 2, Division 1. <br />(4) The structure, following inspection by the building official, was built in conformity with the Building Code, as <br />incorporated in the City Code of Ordinances, as may be modified from time to time. <br />(5) There are no outstanding permit requirements. <br />(6) When the property lies within a special flood zone, an elevation certificate prepared in accordance with FEMA <br />standards is provided. <br />i <br />The building official may institute proceedings to revoke a certificate of occupancy under Article 3, Division 7 of this <br />Chapter 1, whenever the official determines that the certificate has been issued in error, or on the basis of incorrect <br />information supplied, or that the use, dimensions, or other feature of the structure authorized for occupancy, or any portion <br />thereof, is in violation of any provision of this Land Development Code or the Building Code or other construction codes <br />included or adopted in Chapter 14 of the City Code. <br />San Marcos, Texas, Code of Ordinances Page 118 <br />
