Structure of Coirnimlisslion <br />The members of the Planning and Zoning Commission are appointed by the Council and serve without <br />compensation. In making appointments to the Commission, the Council shall seek to ensure broad representation and <br />expertise among the membership. The Commission shall establish bylaws to govern rules of procedure and the annual <br />election of officers. <br />Section 1...2...3...2 ,,. Advisory Capacity <br />(a) The Planning and Zoning Commission shall act as an advisory body to the City Council regarding the City's Capital <br />Improvements Program, and on all matters related to the physical growth and development of the City. The Planning <br />and Zoning Commission shall advise the City Council on applications and petitions for legislative decisions as <br />authorized by this Land Development Code. In that capacity, the Commission shall review, prepare reports upon and <br />make recommendations concerning approval, conditional approval or denial of the following types of petitions and <br />development applications, in accordance with the procedures and standards that apply to the petition or development <br />application: <br />(1) Petition for amending the III, asterComprehensive Plan; <br />(2) Petition for a development agreement; <br />(3) Petition for a zoning map amendment, including a petition for creation of an overlay district, Planned <br />Development PD district, historic district or historic landmark, or Development Transfer (DT) district; <br />(4) Petition for a development transfer; <br />(5) Amendments to the text of the Land Development Code as authorized by the City Charter; and <br />(6) Other advisory duties as assigned by City Council. <br />Section 1...2...3...3 ,,. The Planning and Zoning Commission shall finally decide the following types of quasi - judicial <br />applications: <br />(1) An application for a Subdivision Concept Plat; <br />(2) An application for a Preliminary Subdivision Plat or Preliminary Development Plat; <br />(3) An application for a Final Subdivision Plat or Final Development Plat, for which no Preliminary Subdivision Plat <br />or Preliminary Development Plat, respectively, has been approved; <br />(4) An application for a replat; and <br />(5) An application for a Conditional Use Permit; <br />(6) Residential Compatibility Site Plans. <br />(b) Initial Decision - Maker. The Planning and Zoning Commission shall initially decide the following types of quasi - judicial <br />applications, subject to an appeal to the City Council: <br />(1) An application for a Qualified Watershed Protection Plan; and <br />(2) An application for a Cluster Development Plan. <br />San Marcos, Texas, Code of Ordinances Page 13 <br />
