Ilf;;° Ipiiiir tiiioin and Revocation <br />n <br />(a) Time of Expiration. A Conditional Use Permit shall expire if: <br />(1) A building permit, if any, for the use has not been approved within one year of the date of approval of the permit; <br />(2) The building permit subsequently expires; <br />(3) The use has been discontinued for a period exceeding six months; or <br />(4) A termination date attached to the permit has passed. <br />(b) Revocation. The Planning and Zoning Commission may revoke any Conditional Use Permit that is in violation of any <br />condition imposed on the use in accordance with the procedures of Article 3, Division 7 of this Chapter 1. <br />Section 1 „6 „7 „7 ,,. Appealls l <br />The applicant or other interested person may appeal the decision of the Planning and Zoning Commission to grant or <br />deny a permit to the City Council in accordance with Article 10, Division 1, of this Chapter 1. The Council shall apply the <br />criteria in Section 1.5.7.5 in deciding whether the Commission's action should be upheld, modified or reversed. A three - <br />fourths vote of all of the members of the City Council shall be necessary to reverse a decision of the Planning and Zoning <br />Commission to deny a permit. <br />San Marcos, Texas, Code of Ordinances Page 66 <br />
