Cirliiteirliia for Appirovall l <br />(a) Factors. The Planning and Zoning Commission, or the City Council on appeal, shall apply the following factors in <br />taking action on the Cluster Development Plan application: <br />(1) The Cluster Development Plan meets the standards for residential density or lot coverage as outlined in Table <br />4.1.6.1 in Chapter 4, Article 2, Division 1, subject to any limitations contained within Chapter 5 <br />(2) The Cluster Development Plan is consistent with other zoning district regulations, including any approved <br />Concept Plan in a planned development (PD) district. <br />(3) The Cluster Development Plan conforms to the approved Watershed Protection Plan (Phase 1); <br />(4) The Cluster Development Plan meets the residential compatibility standards in Chapter 6, Article 7, Division 3. <br />(5) The Cluster Development Plan contains sufficient buffering to assure compatibility with adjacent uses and the <br />character of the neighborhood. <br />(b) Conditions. The Planning and Zoning Commission, or the Council on appeal, may impose such conditions on <br />approval of the Cluster Development Plan as are necessary to assure conformity with the Watershed Protection Plan <br />(Phase 1) and compatibility with adjoining uses and neighborhood character. <br />Section 1 .6 .6 ,,. Alplp alll <br />The applicant or other interested person may appeal the decision of the Planning and Zoning Commission to the City <br />Council in accordance with Article 10, Division 1, of this Chapter 1. The Council shall apply the criteria in Section 1.5.8.5 <br />in deciding whether the Commission's action should be upheld or modified. <br />Section 1 „6 „6 „7 ,,. If a Preliminary Subdivision Plat or Preliminary Development Plat has not been approved for land subject <br />to the Cluster Development Plan within one year from the date of approval of a Cluster Development Plan, the <br />Cluster Development Plan shall lapse and no application for plat approval, or application for approval of a Cluster <br />Development Plan on another phase of the development or Site Preparation Permit shall be accepted for filing <br />thereafter, unless the Cluster Development Plan is reinstated. A Cluster Development Plan also shall expire upon <br />expiration of the associated Watershed Protection Plan (Phase 1 or 2). <br />(b) Extension and Reinstatement. The Planning and Zoning Commission may extend the time of expiration for or <br />reinstate a Cluster Development Plan for a period not to exceed one year, in accordance with the procedures in <br />Article 3, Division 5 of this Chapter 1. <br />San Marcos, Texas, Code of Ordinances Page 68 <br />
