All information and documents required in the Technical Manual; <br />b. A concise statement of the reasons why the nonconforming status should be terminated, with specific <br />reference to the rule(s) governing the nonconformity which the petitioner seeks to enforce; <br />c. A detailed explanation of how granting the petition enforces the standards governing nonconforming status. <br />Section 1„ „10...3 ,,. Piroceduire and IlD iii iiioin <br />The ZBOA shall process and decide the petition for termination in nonconforming status as a revocation proceeding <br />under Article 3, Division 7 of this Chapter 1. <br />Section 1„ „1 ,,. Cirliiteirliia for Appiroval and Coin diifiiioin <br />(a) Criteria for Approval. In deciding the petition, the ZBOA shall apply the following criteria: <br />(1) Termination in nonconforming status enforces the rules governing nonconformities in Chapter 4, Article 5, <br />Division 2. <br />(2) Granting the petition does not result in deprivation of a vested property right or deprive the property owner of all <br />economic use of the land. <br />(b) Conditions. If the ZBOA determines that termination in nonconforming status would be warranted but for the <br />confiscatory impact on the property owner, the ZBOA may attach additional conditions to continuing nonconforming <br />status that protect the public interest, or the ZBOA may identify and apply a reasonable amortization period before <br />terminating the nonconforming status. <br />San Marcos, Texas, Code of Ordinances Page 72 <br />
