AppIllicatiloin Requirements <br />(a) Responsible Official. The II 24aRr;iRiq.. -II )Di rector shall be the responsible official for a Subdivision Concept Plat. <br />(b) Submittal. An application for a Subdivision Concept Plat shall be submitted on a form provided by the Director. <br />(c) Contents. An application for a Subdivision Concept Plat shall be prepared in accordance with Chapter 1 of the <br />Technical Manual. <br />Section 1...6...2„ 4 ,,. IDeclislion <br />The Planning and Zoning Commission shall decide whether to approve, approve with conditions or deny the <br />Subdivision Concept Plat application. The conditions may relate to, among other matters, compliance with the City <br />MM: sterComprehensive Plan, and the availability and capacity of public improvements. <br />Section 1...6...2 „6 ,,. The following criteria shall be used to determine whether an application for a Subdivision Concept Plat shall <br />be approved, approved with conditions, or denied: <br />(1) The Subdivision Concept Plat is consistent with all zoning requirements for the property, and any approved <br />development agreement; <br />(2) The Subdivision Concept Plat conforms to the approved Watershed Protection Plan (Phase 1); <br />(3) The proposed provision and configuration of roads, water, wastewater, drainage and park facilities is adequate <br />to serve each phase of the subdivision and generally meets the standards of Chapter 7, Article 1; <br />(4) The schedule of development is feasible and prudent, and assures that the proposed development will progress <br />to completion within the time limits proposed; and <br />(5) The proposed Subdivision Concept Plat meets residential compatibility standards in Section 6.7.3.1.; <br />(6) If the land lies within a Planned Development (PD) zoning district, a Development Transfer Receiving DTR <br />zoning district, or is subject to a Cluster Development Plan, the proposed Subdivision Concept Plat conforms to <br />the PD or DTR district regulations and is consistent with the incorporated Concept Plan, or is consistent with the <br />approved Cluster Development Plan; <br />(7) The location, size and sequence of the phases of development proposed assures orderly and efficient <br />development of the land subject to the plat; <br />(8) Where the proposed development is located in whole or in part in the extraterritorial jurisdiction of the City and is <br />subject to an interlocal agreement under Tex. Loc. Gov't Code ch. 242, the proposed Subdivision Concept Plat <br />meets any county standards to be applied under the agreement. <br />(b) Conditions. In addition to any other conditions required to conform the plat to the standards of this Land Development <br />Code, the Planning and Zoning Commission may condition approval on exclusion of land from the Subdivision <br />Concept Plat or adjustments in the proposed sequence or timing in the proposed phases of the development. <br />San Marcos, Texas, Code of Ordinances Page 80 <br />
