Construction IPIllain <br />(a) Purpose. The purpose of construction plans is to assure that public improvements required to be installed in order to <br />serve a subdivision or a development are constructed in accordance with all standards of this Land Development <br />Code. <br />(b) Contents. An application for approval of construction plans shall be prepared in accordance with Chapter 1 of the <br />Technical Manual. <br />(c) Responsible Official and Decision. <br />(1) The Engineering Director shall be the responsible official for approval of construction plans. <br />(2) For construction plans submitted following approval of a Preliminary Subdivision Plat or Preliminary <br />Development Plat, the Engineering Director shall approve, approve subject to modifications, or reject the <br />construction plans within 30 working days after the plans have been submitted. Incomplete plans shall be <br />returned to the applicant. <br />(3) For construction plans submitted where no application for Preliminary Subdivision Plat or Preliminary <br />Development Plat has been submitted for approval, the Engineering Director shall approve, approve subject to <br />modifications, or disapprove the construction plans, subject to appeal as provided in (g) below. <br />(4) If construction plans are approved, the plans shall be marked "approved” and one set shall be returned to the <br />applicant, and at least two sets shall be retained in the City's files. <br />(5) Once the construction plans are approved, the property owner shall provide additional sets of the approved <br />plans to the City, as specified by the Engineering Director, for use during construction. A full set of the City - <br />approved and stamped construction plans must be available for inspection on the job site at all times. <br />(d) Notification. The Engineering Director shall notify the applicant of the Director's decision in accordance with Article 3, <br />Division 2 of this Chapter 1. <br />(e) Time for Decision. The decision on approval or denial of construction plans shall be made within 30 working days of <br />the official filing date. <br />(f) Revised Plan Submission. If the conditions of approval require revision(s) to the construction plans, one set shall be <br />marked with objections noted (on the plans themselves and /or in memo format) and returned to the applicant for <br />correction, whereupon the applicant's engineer shall correct the plans as requested and resubmit them for decision. <br />A properly revised set of construction plans shall be submitted to the Engineering Director within ten working days of <br />receipt of the notice of decision. The Director shall have an additional 20 working days to approve or deny the <br />revised set of plans. <br />(g) Appeal. Where construction plans are submitted after approval of a Preliminary Subdivision Plat or Preliminary <br />Development Plat, the Engineering Director's decision on the plans may be appealed to the Planning and Zoning <br />Commission in accordance with Article 10, Division 2, and shall be decided in conjunction with the Commission's <br />decision on the Final Subdivision Plat or Final Development Plat application. An appeal of the Director's decision <br />must be accompanied by a Final Subdivision Plat or Final Development Plat application, and the grounds for appeal <br />shall be certified and documented by a professional engineer licensed in the State of Texas. <br />(h) Criteria for Approval. The Engineering Director or the Commission on appeal shall render a decision on the <br />construction plans in accordance with the following criteria: <br />(1) The plans are consistent with the approved Preliminary Subdivision Plat or approved Preliminary Development <br />Plat, or the proposed Final Subdivision Plat or proposed Final Development Plat; <br />San Marcos, Texas, Code of Ordinances Page 92 <br />
