ORDINANCE NO. 2013-42 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS AMENDING SECTION 1.5.1.4 (G) OF THE CITY'S <br />LAND DEVELOPMENT CODE TO ESTABLISH A ONE -YEAR <br />WAITING PERIOD BEFORE ZONING AMENDMENTS MAY BE <br />CONSIDERED AGAIN AFTER THE APPLICANT HAS WITHDRAWN <br />THE SAME REQUESTED CHANGE OR MODIFIED THE BOUNDARY <br />OF THE PARCEL OF LAND SUBJECT TO THE SAME REQUESTED <br />CHANGE; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR THE <br />REPEAL OF ANY CONFLICTING PROVISIONS; AND PROVIDING AN <br />EFFECTIVE DATE. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. Section 1.5.1.4 (g) of the City of San Marcos Land Development Code is <br />amended as follows (added text is indicated by underlining and deleted text is indicated by <br />ntr- ikethfe .tghs). <br />(g) Waiting Periods for Certain <br />Amendments. A request to change the zoning district designation for a tract of <br />land shall not be considered by the Planning and Zoning Commission or the City <br />Council within one year of any of the following: <br />a the Council's deeisieff vote to deny the same requested change <br />for all. or any portion of the parcel; <br />withdrawal of the same requested change b t�pplicant after the <br />city council meeting at which the change is to be considered has <br />been called to order; or <br />tD a change to the boundary of the same requested change by the <br />applicant after the Planning and Zoning Commission has voted on <br />the matter. <br />The one-year waiting period may be waived if Mess the Commission and <br />Council each determine that there has been a substantial change in conditions <br />surrounding the parcel since the initial request, and agree to reconsider the change <br />by a three - fourths vote of the members present and voting, <br />SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance is <br />held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of <br />this ordinance will continue in force if they can be given effect without the invalid portion. <br />
